December 27, 2025Dec 27 President Donald Trump's legal war on a Salvadoran immigrant was dealt a bitter blow on Friday, as a federal judge in Tennessee canceled the current date for his trial on human smuggling charges — and will instead hold a hearing on the legality of the prosecution. The order, by U.S. District Judge Waverly Crenshaw, was first reported by NBC Washington's Paul Wagner. It comes after Kilmar Abrego Garcia's legal team presented evidence that he was being targeted for selective and vindictive prosecution. Crenshaw added that if the one-day evidentiary hearing on vindictive prosecution, now set for Jan. 28, goes against the government, the charges against Abrego could be dismissed outright. It's the latest setback for the Trump administration in the Abrego case, after a court ruling earlier this month that he must be released from federal lockup. Kilmar Abrego Garcia, a Salvadoran migrant who lived in the U.S. legally with a work permit and was erroneously deported to El Salvador, is seen wearing a Chicago Bulls hat, in this handout image obtained by Reuters on April 9, 2025. December 27, 2025Dec 27 The case will probably get thrown out. Then the way thing have been happening in the US lately, they guy will be caught for some other felony.
December 27, 2025Dec 27 A Court Filing Revealed Todd Blanche’s Office Closely Oversaw the Prosecution of Abrego Garcia The DOJ has said indicting Abrego Garcia was an independent decision by prosecutors in Tennessee not mired by politics. December 22, 2025 The filings from defense lawyers detail how Blanche’s deputy Singh was in touch with the acting U.S. attorney for the Middle District of Tennessee, Rob McGuire, in April, nearly a full month before the indictment — sending a flurry of emails in which McGuire offered updates on timing and they discussed legal strategies. The pair stayed in close contact for weeks, with Singh even asking for what appears to be an update on the effort the day before Abrego Garcia was indicted. For months, DOJ officials have claimed Main Justice did not direct Abrego Garcia’s prosecution. https://www.notus.org/courts/abrego-garcia-doj-todd-blanche

Dec. 23, 2025 via AP However, officials have made no effort to deport him to the one country he has agreed to go to — Costa Rica. (Judge) Xinis has even accused the government of misleading her by falsely claiming that Costa Rica was unwilling to take him. The government's "persistent refusal to acknowledge Costa Rica as a viable removal option, their threats to send Abrego to African countries that never agreed to take him, and their misrepresentation to the Court that Liberia is now the only country available to Abrego, all reflect that whatever purpose was behind his detention, it was not for the 'basic purpose' of timely third-country removal," she wrote. In court Monday, Abrego's attorneys reiterated that he is prepared to go to Costa Rica "today." https://www.nbcnews.com/news/us-news/judge-allows-kilmar-abrego-garcia-remain-free-considers-immigration-is-rcna250554
May 22May 22 Judge dismisses criminal case against Kilmar Abrego GarciaThe judge called it a vindictive prosecution.Updated: 05/22/2026 05:25 PM EDTA federal judge has thrown out the Trump administration’s criminal, immigrant-smuggling case against Kilmar Abrego Garcia, ruling that the prosecution was “vindictive” retaliation against the Salvadoran immigrant for winning a high-profile challenge to his deportation from the U.S.Crenshaw said there was significant proof, including statements from now-acting Attorney General Todd Blanche, indicating that the investigation into a 2022 traffic stop of Abrego in Tennessee was re-opened last year in response to a federal judge in Maryland ruling that Abrego’s deportation was illegal and authorities needed to facilitate his return to the U.S.“Another activist judge has placed politics above public safety,” a DOJ spokesperson said in a statement. “The judge’s order is wrong and dangerous, and we will appeal.”https://www.politico.com/news/2026/05/22/judge-dismisses-criminal-case-against-kilmar-abrego-garcia-00934244 Edited May 22May 22 by JerryM

May 23May 23 Judge dismisses charges against Kilmar Abrego Garcia, saying Todd Blanche spurred a ‘tainted investigation’Updated May 22, 2026, 4:57 PM ETMeanwhile, officials at the Department of Homeland Security have been attempting to deport Abrego Garcia to various countries in Africa despite Costa Rica’s willingness to accept him and give him some form of legal status. He was unable to self-deport to that country due to the release conditions imposed on him by Crenshaw. It remains unclear what will happen next. Under an order Crenshaw issued Friday, Abrego Garcia is no longer bound to the release conditions.
