Help for motorbike accident

So I must ask those in the know perhaps a bush lawyer who knows Thai law ?

Perhaps a Rumpole of Thailand or in this case Rumpole of Pattaya

Ok so this my dear fellows is the scenario

A Thai man is riding his motorbike ...he turns left onto a road in Pattaya, in front of a farang (allegedly) speeding and hits the Thai man on the motorbike causing him to fall into the road where he (the Thai man) sustains injuries , a broken arm and back cut requiring stitches and time off work

Now the farang apparently was driving a rent a bike, police were involved

Now the Thai guy admits fault ,he has asked my farang friend what to do , his farang friend has asked me as I'm a Academic but more into statistics than Law but can we get back to the topic please !

I suggested he see a lawyer

Shouldn't there be some kind of insurance from the rent a bike company on behalf of the farang to give to the admitted "at fault Thai Man who apparently cannot work for several months due to his injury

Oh look can we keep it simple please , surely that's not too much to ask !!!!!

What can this Thai man do to get compensation, simple questions isn't it !

Genersally the Police act as mediators, they try to resolve the issue amicably between the parties involved.

He assesses the damge etc, asks for X amount - its agreed in fronmt of the cops - default and it goes to court.

Thats how it generally works - I know because Ive just been through it with my daughter.Handled right and resonably and lawyers are not needed, thats the whole point.

I am told the police were on side of the motorbike company

I don't know all the details though

You say it's the Thai man's fault but for some reason he wants compensation? hopefully he has govt tax and insurance, he is covered for 30k+ medical

If it goes beyond the Police mediation process, and ends up in the hands of lawyers then a "bush lawyer"

A bush lawyer I believe is someone who claims to have knowledge of the law, but has no formal qualifications either in law or allowing him to practice law.

He simply would not be recognised or heard in a Thai court - especially if he were a foreigner.

Start by ascertaining whether "your friend" has a valid driving licence for a motorcycle - if not then he will probably be held to be to blame.

If it is not resolved by the Police mediation and ends up in court then "your friend" will need to hire a Thai Lawyer.

A few THB notes and the case will swiftly be solved in the favour of the "donator".

Your probably in a wheelchair and in a Care home , and this is what this forum is also for , a Community service for those in nursing homes or are experiencing lonely times , you are unique and diverse and make up the forum community with your disabilities where you are truly loved by all of us

Real or not, several years ago in Jomtien police station Na Jomtien I was asked by a farang friend how to proceed I ended up curious and went with him to the station. This was going to be his second visit. The first visit there at the meeting, the captian, the lady who was on bike like your case admitted to the accident along with the Farang Insurance agent policy purchased through a Bank, at that meeting he was requested to pay the lady rider 200,000 baht he was in shock! The insurance agent said his policy would only cover 100,000 to the lady rider the rest will have to be covered by him. Prior to going to the second meeting in the car farang friend wife noted to me it was standard that we should pay that amount.

This was not surprising to me since in Thailand uneducated Thais feel Farangs are always at fault therefore should pay. Since I've know them for sometime I told her when we get there don't say a thing just sit there and look pretty, if you open your mouth and he does have to pay that hundred will be coming out of your monthly allowance.

At the station I didn't say a word and just listen to all of them, the captian repeated the settlement 200,000 baht, what follow while I sat was really stupid and ignorant. The captian noted since you are a farang and have the money should pay the amount " you would feel better about yourself "

🤣after the conversation after a moment I joined in since I could speak and understand enough Thai but spoke in both. I asked the lady first do you have a Thai driver license NO! Is the bike register NO! I turn to the caption showing respect gave him a Wai! Is it your job to uphold the Thai law or here to endorse the behavior and uplift the lives of Thai who admitted wrongdoing this was said in a very humorous way looking straight at him with a smile!

He just sat there everyone sat there silent it was like playing cards who was going to brink first! After around ten minutes I said to my friend we are going to get up and leave this isn't a criminal matter but a Civil they can break the law by holding you but it would be stupid. Finally, I turn and spoke to the Captian told the insurance agent to come to the desk his comments " smelled really bad " I noted to both of them this is the Thai Driving law in which you are here to uphold showed them the driver handbook look at the agent said my farang friend who is the policy holder is requesting no payment to be made whatsoever to this lady not 100,000 baht, then to the captian handed him a Attorney Calling Card International law firm a friend and showed them two Business calling cards from Department of Corruption head in Bangkok and anothe from office in Chon Buri, told the captian we are leaving if you want another meeting please call the Attorney first.

We slowly turned and to be honest nervously started to walk out hoping not to be stopped😇that was 3 years ago!

A few days later we went to the bank where the policy was purchased after a number of phone calls we were finally able to speak to a person of authority told that isn't normal procedure nor would they make payment on a policy unless it was the policy holder fault! What this agent was doing and I found out very common because we are farangs write the accident up that my friend was at fault thus the payout of 100,000 but they ask for 200,000. It is assume because all farangs are scared and stupid of going to jail 200,000 OK, drop in the bucket make it go away quick. My guess the 3 party lady, agent and captian was going to split the 200,000

In the end, I heard the agent was fired!

Now I know you said keep it short not happening, The standing around is standard even though they know at fault. Waiting around for you to pee in your pants scared O.K. they do this because it well known amount Thais we have it so we should pay, their own Supreme Court has use this to rule against duel pricing. You can pay or just walk away it is a poker game here.
