3 days ago at 5 AM, a friend (Thai citizen) was hit by a Thai-Chinese rider who pulled out of a side road without looking. Both were on motorbikes. She was knocked unconscious for 6 hours, suffered a brain bleed, internal injuries, and slurred speech. She spent 3 days in a semi-private hospital.

Today, right after being discharged, she went to the police station. She was made to wait 5 to 6 hours for the at-fault rider to arrive. The police appeared to know the rider personally.

The police pushed through a settlement where the at-fault rider paid 50,000 THB. The police also extracted a 5,000 THB fee from the 50k just for contacting him. The remaining money does not even cover the outstanding hospital balance or the bike repairs, let alone future medical complications.

We need an aggressive civil litigator with zero ties to the local police to step in. The objective is to get the settlement voided due to medical incapacity (she signed while suffering acute head trauma) and pursue actual damages.

In Thailand the normal outcome is a quick police-station settlement. The focus is simple: cover hospital bills, repair the bike, add some compensation, and close the case. Arguments about possible future medical problems rarely carry much weight unless the injuries are clearly severe. So a payment like 50,000 THB—fair or not—actually fits the kind of compromise police often push through.

And then there’s the practical side. Pursuing a civil case means legal fees, time, and uncertainty. Even if you win, you still face another issue: collecting the money. If the person at fault doesn’t have assets or insurance, enforcing a judgment can be extremely difficult. That’s why many people in Thailand accept a quick settlement—sometimes the “bird in the hand” approach makes more sense than chasing a larger amount that might never be received.

This aint Kansas - and things do operate very differently in LOS

Then why did she agree to the settlement ? was she coerced by the police ?

Was she wearing a helmet ? - that may not matter to some regarding cause or fault, but it could be argued that she was riding illegally without a helmet which exacerbated her injuries (if thats the case).

Props you carrying this forward and pushing this - its horrible to see the weak being taken advantage of like this - and the police don't care - they just want their money - the Chinese man may not care - he's considered the case done and dusted.

The OP's friend is virtually guaranteed to be like most Thai scooter riders in that A) She wasn't wearing a helmet, and B) She didn't have (never had) insurance, and possibly C) it wasn't her scooter.

So, the next step is D) suck it up buttercup. Since the OP's friend is Thai, she probably already is.

Best to leave Thai business to Thais.

She would know to collect 30kbht from her gov min insurance, but no mention of that.

She's lucky the guy even turned up and that she got any money at all. In lots of similar cases, it's 0.

Given the injuries you describe, it is safe to assume she wasn't wearing a helmet? If so, this will be used against her in a court case. And, as harsh as that may sound, it is the main reason she is in this predicament.

A lawyer will take an expensive fee first, with no guarantees of results.

As BritManToo said, Thais reach arrangements together, it would have been more complicated if she was foreign. Hospitals usually arrange installment plans for the remaining balance, as well as Por Lor Bor payments.

Reminder to all bike riders: wear a certified helmet, even a fall at low speed can cause life-altering injuries.
