DTV and 90 day report

Hi, sorry about my English and little acknowledgement about visas.

One friend is in Thailand with a DTV visa since December, should he have done a 90 days report? He hasn't. If so, is it mandatory to make it in where he put as address of residence?

Thanks for any advice.

Does your friend obtain extension stamp at immigration or by staying less than 180 days then exit and reenter..

He wants to stay about 150 days, then go back to UK and return after a few weeks

Yes, that's what many DTV guys do.

Fact is 90 reports are not check at airports on departure nor return.

In reality not doing 90 reports would not be a concern unless you had dealings with immigration.

Others may suggest to do a 90 report.

If I had a DTV, wouldn't bother as like many I would always exit prior to 180 days

Yes would be different as he would need to attend immigration for extension and io may notice no 90 report has been made since last entry

To avoid confusion: There is no difference between staying 150 days or 180 days. It is only different if he chooses to extend the DTV at immigration instead of leaving Thailand.

Longer than 180 requires extension at immigration.

Anyway the OP has clear understanding.

Yes, I am serious; no, your post was not very clear for a person that does not know the rules already.

Your post said "180 days", not "longer than 180 days". There's a difference between the two, as he can leave Thailand on day 180 and then he does not need to visit immigration for an extension.

Stop nonsense. If someone on DTV opts to stay in Thailand under 180 days then 90 reports would not be an issue.

You are helping a lot of people here, which is great. However, it is a bit sad that you cannot accept that you may have given a wrong or unprecise answer (I have seen it in other threads as well). Your reply, which I am quoting here, is correct; however, that is not what you said earlier. The OP did not say more than 180 days, he said 180 days when you replied with the need to visit immigration.

Anyway, I do not want to argue with you, I just wanted to make sure that the OP knows that staying 180 days does not mean you have to visit the immigration.

By the law of the land, section 37 (5) anyone staying consecutively for more than 90 days should submit a 90 day report.
That said, many DTV holders do not comply with that specific law.
If you have no reason to visit your local Immigration office, then they won't be aware.

However should at any time you need to visit your local Immigration office, for example for a Certificate of Residence, and they discover you haven't been submitting 90 day reports, then the law states;:
Section 76 : Any alien, alien, who fails to comply with the provisions of Section 37(2),(3),(4)or(5) shall be punished with a fine not exceeding 5,000 Baht and with and additional fine not exceeding 200 Baht for each day which passes until the law is complied with.

I have a DTV.

I usually stay over 90 days and always under 180 days. I usually do the 90 day report.

However, on one occasion, I needed a COR at short notice. I had been in the country for about 110 days. I obtained the COR from Jomtien Immigration. They did not notice that I had not done my 90 day report.

The only question your friend needs to ask him/herself is "Will I have any dealings with Immigration during the remainder of this stay in Thailand?" If the answer is "No", then he/she will not have any problem. If the answer is "Yes", then he/she may be fine or may get a 2000 Baht fine.

Stop. Yes if exited on expiry of 180 day stamp then would not need to obtain extension from immigration office.

Clearly I was referring to exiting Thailand prior to expiry of stamp to avoid extension application.

Who would leave applying for extension to very last (expiry) date.

Do you understand what a permission of stay stamp is?

The OP has two clear options.

Obtain an extension at local immigration office prior to expiry or exit/reenter Thailand.

Yes, he should have completed a 90-day report. This can be done up to 15 days prior to and 7 days after the due date, and must be completed in the district where the TM30 has been filed. If your friend leaves before 180 days there will not be a problem , as border immigration do not know he failed to report. However, if he needs to deal with his local immigration office for any reason then it will be a problem. His first 90-day report must be done in person, and everytime he re-enters Thailand this resets the 90-day clock and also becomes a first report again.
