The 22nd Amendment’s plain language clearly states that a person twice elected as president cannot run in an election for a third term. “No person shall be elected to the office of the President more than twice,” the amendment states. “And no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.”

English is my first language. Show me in the Constitution of the United States of America (and its amendments) where it says anybody may not "run or seek" election for a third or subsequent term for the office of the President of the United States of America. It doesn't, because those words are not used in the structure of the Constitution and its amendments.

Call me a pedant, but nobody (other than those who do not qualify as US citizens or qualify under the age requirements and criminal record in accordance with the Constitution) is prohibited from seeking election to the office of President. There is however a proviso in the constitution that prevents the Electors from ratifying any common vote that does not comply with the requirements of the Constitution. That's why the Electors are an extremely important part of the process that determines who becomes the President.

Language is important. In accordance with the Constitution Trump cannot be appointed for a third term as President by the Electors, but nothing prevents him from "running or seeking" to be elected to that position. In fact, preventing him (or attempting to prevent) him from doing so would automatically contravene his first amendment rights.

It's a circular conundrum.

As referenced above, whether Trump or anyone else can get on a state's presidential ballot as an independent or write-in candidate is a state by state decision. Some require pre-registration and a least for 2 no write-in candidate for President allowed. Then the Secretary of State for any such state would have to agree that the candidacy is valid under existing constitutional requirements.

So Trump in order to assert his first amendment rights would have 50 lawsuits on his hand.

If the Democrats are going to be so picky that they expect judicial nominees to know the law, much less the US Constitution, well, that's just too much! Don't Dems understand MAGA DEI? Ignorance of the law is not a limitation, it's a job requirement under Trump.

Anyway, if Trump runs in 2028, I guess Democrats and Independents can vote for Barack Obama, who merely ran twice and won twice. Goose and gander.
