Yes. However if he declares a state of emergency just prior to the election date, and does just that, by the time the courts rule and appeals are heard it will be too late. The election will be trashed and he retains a majority in Congress.

The key is Johnson. If the Democrats do achieve majority then he will use any and all excuses to avoid swearing in. If the Republicans achieve a majority then they will be sworn in double quick
