Mortgage - House In Son's Name

Hi,

Apologies if this is a daft one, but just about to get a mortgage with Thai wife and was wondering if there's a way the boy (half, half) can be on the Chanote? I guess the bank holds onto the Chanote until the mortgage is up (and being a minor he couldn't have the mortgage in his name anyway), but is there a way to have him automatically the owner without intervention once the mortgage is up, or would one have to take care of that with wifey at the land office as and when the time arises?

Buying outright is the obvious answer to have the house in the son's name, but that is not an option at this time.

Your son will not be able to get a mortgage so the house and the mortgage will need to be in your wife's name.

You may be able to take a long term lease on the house (though the mortgage provider would probably block that).

Alternatively, if putting the house in your wife's name is a problem consider buying a condo, which can be in your name. Or since you are having to borrow anyway, why not rent and put money into long term savings for your son.

A few thousand pounds invested in a medium risk Unit Trust would almost certainly provide him with a great start in life for his early twenties.

There's no problem putting it in the wife's name at this juncture but would hope to get it in the boy's name eventually. Will be investing for him in the West anyhow but it would also be nice to cover the angle on the house over here. Already been renting here for several years and fancy a bit more permanence to be fair... whatever that is...

This can be done, and is best done by a competent and trusted real estate attorney.

One problem: should you desire to sell, you must petition the court to do so (cost) unless the child is over eighteen.

Easily done at the land office without the help of an Attorney.
