January 6, 200818 yr Can anyone out there advise on time scales between getting a settlement visa and travelling to the uk? Basically my step son who is 9 years old has just received his settlement visa to come to the uk, however to to work commitments my wife and i cannot travel to Thailand until May 2008. Will this cause a problem with the settlement visa? I've heard that you need to travel within 30 days of receiving this visa or it will be void?
January 6, 200818 yr See also 1.3 - Validity of entry clearance and leave to enter and Completing application form SET(M). The visa won't be void after 28 days (4 weeks). However, if they travel later than that, they may have to apply for an extension prior to qualifying for settlement. Do read the form SET(M), for the settlement requirements, as soon as possible.
January 6, 200818 yr You should check the 'valid until' date on the settlement visa, I have seen them with 6 months and 5 years but provided he enters before the 'valid until' date there should be no problem. He shouldn't have a problem about ILR or FLR as his visa should be Synchronised to your wife's visa/permission to remain.
January 6, 200818 yr Sorry. Mahout Angrit is correct. I had misread and thought that your wife had not already entered the UK. If she is in the UK on a spouse visa then her son's visa will be in line with hers. If she has ILR, then he should be given ILE. He should enter the UK between his visa's effective and expiry dates.
