My 89 yr old father, who I am caregiving is slowly 'loosing it' and at some point I will have to take care of his legal and financial matters as well as immigration requirements.

I will be the logical choice for legal guardienship and wonder if the act will have to be innitiated in his home state, or can be done thru the US consulate, or a local attourney.

Does anyone out there know or have experience with this??

There are two types of conservatorship proceedings (guardianship is only used for minors now): over the person, and over the property. The proceeding must be initiated where he is domiciled (state court). If he is here in Thailand, you can have a local attorney handle it, except that any property in the U.S. would have to be handled through an ancilliary proceeding. If he is in the U.S., it will have to be handled there. Also, if a U.S. state court handles it, and you are living in Thailand, it may be difficult for you to be appointed the conservator. At a minimum, you will have to get a bond posted with the court. If your father is still competent, I would have a U.S. attorney create a living trust, with powers of attorney, and you can bypass the conservatorship hassle.
