90 Day Rule Question

Featured Replies

Hi there.

I am still a bit confused about the 90 day rule and am in need of some clarification as to my entry-visa eligibility. I would also like to apologise to those who have posted plenty of information regarding the 90-day rule.

I am a British passport-holder and have already travelled to Thailand during:

5th Oct 2007 - 24th Oct 2007 (20 days) - Received 30-day entry visa at the airport.

26th Jan 2008 - 24th Feb 2008 (30 days) - Received 30-day entry visa at Thai-Malaysia Border.

20th Mar 2008 - 17th Apr 2008 (29 days) - Received 30-day entry visa at the airport.

24th Apr 2008 - 23rd May 2008 (30 days) - Recieved 30-day entry visa at Friendship Bridge.

Due to my first arrival date on the 5th October 2007 I believe that my 6 month (90 day) period ended on the 5th April and in this time i spent only 67 days as illustrated below. If this is correct, do you believe that i have no problem because i would now be in a new 6 month (90 day) period and as a consequence would not affect my flight home out of Bangkok on the 1st of June? Both me and my girlfriend really hope this is the situation.

My first 6 month period

5th Oct 2007 - 24th Oct 2007 (20 days)

26th Jan 2008 - 24th Feb 2008 (30 days)

20th Mar 2008 - 5th Apr 2008 (17 days) = 67 days in 90 days

My second 6 month period

5th Apr 2008 - 17th Apr 2008 (13 days)

24th Apr 2008 - 23rd May 2008 (30 days)

7 days in Malaysia then re-entry to Thailand to catch plane home on June 1st

28th May 2008 - 1st June 2008 (5 days) = 48 days in 90 days

After my current 30 day visa expires myself and my girlfriend are planning on spending a few days in Malaysia and then re-entering Thailand so we can catch our flight home. Do you believe that i would be refused a 30-day entry visa on re-entry at the Thai-Malaysia border?

Any help would be greatly appreciated.

Thanks.

Steve & Louise

Really hard to say. Depends on how the immigration agent decides to calculate the 6 month period. I have read about people who came in on an entry that would cross over their 6 month anniversary and they were not given 30 days even though they were not close to their limit. It looks like they did not do this to you on your previous entry. So who knows how they will count it.
