Hi All,

this issue has been mentioned before but I wish to clarify a point. I was in receipt of tax credits and it was paid to myself. My Wifes names was on post etc from the tax credits. I told them that she was not a British National etc and they still added her name.

When filling in the ILR form I only put myself as in receipt of tax credits, is that wrong or right? Would this affect my application?

As your wife is named on the tax credits application, she is technically in receipt of the benefit. However, this is the one benefit on the list of public funds which may be ignored when the foreign national named on a claim is in the UK on a settlement visa. I'd tick that your wife has been in receipt and explain in a covering letter that it is of no consequence to the outcome of her ILR application.
