Article 43 says Pregnant women cannot be laid off on basis of their pregnancy. However, this seems to have a loop hole, as the company can give other reasons for laying off a pregnant woman, even if the actual reason is pregnancy and anticipated under perfomance. How is the rights of the pregnant woman protected in this case?

Occurs to me that the pregnant woman ought to go straight to the Labour court, show proof of pregnancy if it isn't obvious, and make a claim against the company for unlawful termination.

However, if the woman is pregnant by coincidence, and really did not perform her duties properly... she should take the termination pay and leave it at that, or else she could end up with nothing.

The company knows that it will have to be able to justify the layoff - so there could be something to it.
