The technical answer is: Working of Aliens Act, BE 2521 (1978) - Section 34:

Any alien who ... works without a permit ... shall be liable to imprisonment for a term not exceeding three months or to a fine not exceeding five thousand Baht or to both.

If you also do not have a non-immigrant visa, you are then also in violation of Immigration rules - that is where you can end up in the IDC, and then be deported persona non grata.
