She needs the father's permission to take them out of the country. Is that correct? He has never paid any maintenance and has minimal contact with his kids. I get the impression that if he thinks that they might go abroad that he will expect a wodge of cash before he will give permission.

Custody needs to be cleared in court, whether he is around or not. If she gets a lawyer, have the courts run it's course and if he doesn't turn up to defend his right then she can proceed as sole guardian. Laws are in place to allow this to happen, but then they are also in place to protect the father no matter how irresponsible he may be....
