Maybe I am havng a bad day but I can not find the answers to my following questions. Any help would be greatly appreciated.

If I want to get an extention of stay based on marriage does the 400k have to be transferred from an overseas bank?

If I do not have an overseas bank account but all my funds are in a Thai bank can you just show this to prove you have the 400k?

Lastly does the 400k have to be 400k every year or can it just be topped up to the 400k?

As I understand it, if you have not had an extension of stay based on marriage prior to (I forget the date, just say before now for this discussion), the 400,000 THB in the bank is not an option. You have to show 40,000 THB/month income between you and your wife.

Yes . A monthly income of 40,000 Baht is the option for new applicants.

It can be yours, your Wifes or a combination of both.

This is the rule. October 2006

(6) In the case of an alien married

to a Thai woman, any party or

both must have a total income

of not less than Baht 40,000 per

month, except for aliens who

entered the Kingdom before

this Order came into force and

granted a permit to stay in the

Kingdom. If the alien does not

have the minimum income

above, he shall have an account

deposit in Thailand in the name of either party or both of not

less than Baht 400,000. Proof

of account deposit for the

previous 3 months is required.

I am sure that this has been hashed over in the past, and our commonly-held interpretation is correct...

but reading the text, one *could* make the following interpretation:

(a) Unless you have a permit from before the Order, you must show 40,000 THB/month income

(b)If you are required to show income per (a) and cannot, then you must have 400,000 THB on deposit for the previous three months

Note that I am not saying this interpretation is correct, but it certainly could be read that way.

Do we have a definitive answer on this, or have we all just been assuming that the income requirement is what applies to us and doing it that way?

Has anyone asked Immigration and gotten a definitive answer?

The above is the Thai Police version translated into English.

If you look at the Sunbelt Asia translation it does make it more clear.

However the only version that counts is the Thai Police version in Thai.

I have no reason to disbelieve that the 400,000 option is not available, and surely discrepancies can come up in translation.

I would rather show monthly income than have a large chunk of money sitting in a foreign bank anyway.

My wife has read the Police Order. Her interpretation is the same as yours. (:o to be exact.
