tuffy Posted September 11, 2008 Posted September 11, 2008 Has anyone had any luck filing for an usufruct on land in the Sattahip district? Did you do it your self or have legal help?
tuffy Posted September 12, 2008 Author Posted September 12, 2008 How about in the surrounding area even such as Rayong or Pattaya? I would like to start this process myself but was hoping someone had done this previously in this area to give me a few tips. From reading past threads on this subject it seems that many officials are unfamiliar with this type of lease and could be quite difficult to get done. If you have past experience with this especially in this area let me know how the process went for you.
longball53098 Posted September 12, 2008 Posted September 12, 2008 I too want to do a Usufruct in Banchang but I am learning that the local Amphur here in Banchang under any circumstances will not allow a usufruct. They will do leases,,,,no problem
tuffy Posted September 12, 2008 Author Posted September 12, 2008 That's what I am worried I will run into with the Sattahip officials as well!
longball53098 Posted September 13, 2008 Posted September 13, 2008 A lease is an acceptable alternative I think-----------at least for me
tuffy Posted September 13, 2008 Author Posted September 13, 2008 A lease is an acceptable alternative I think-----------at least for me Yeah a lease is one option but the problem is it only lasdts for 30 years (unless renewed) and I plan to last longer than that, the nice thing about the Usufruct is it lasts a lifetime.
longball53098 Posted September 15, 2008 Posted September 15, 2008 The 30 year lease with an option to renew for another 30 can be added to the lease contract I believe but no lease can be added to a Chanote for longer than 30 years. As I am in my 60's,, 30 years is plenty for me.

The thing with a Usufruct is it can be made for my life time ( I am still in my 30's ), and unlike a lease rent is not required. I would prefer to go this way but It seems no one has gone before me here to test the waters, so we'll see how it turns out...
