Hi everybody, I've got some questions again :o

1. I'm divorcing my French hubby after living together since 04. He said he won't sign a divorce doc. Would I can force him to divorce me? I'm not happy with him anymore.

2. How long does it take to get divorced?

3. As he didn't help me to get a Residence Card so I have to apply for one after the divorce. I heard that the HO will need some evidence that we lived together which is gonna be difficult as my hubby doesn't want to help.

4. I'll consult DaviesKhan. Anyone has consulted this company before. I'm going use them as my lawyer.

1. Where did you marry him? France, England, Thailand?

2. Depends which country law is used.

3. Surely you have photo's in your home together or neighbours can verify that you were together.

4. Excellent choice. If anyone can help I'm sure they are the ones.

DavisKhan are immigration specilaists & I would def use them regarding your immigration status but they are not divorce lawyers afaik, but they probably know some. Good luck :o

There are a few circumstances you need to explain if you are seeking a UK divorce. For example:

1. If your husband deserted you and you have been apart for two years, you can petition for divorce on the grounds of desertion

2. If you have lived apart for two years and both agree, either one of you can petition on the grounds that you have lived apart for two years.

3. You have to have lived apart for five years if one party does not agree to a divorce. In that case, if you left him and he would not petition you for a divorce, you could petition after five years on the grounds that you have lived apart for five years.

4. Possibly difficult to prove, but you could also petition on the grounds of physical or mental abuse or, if you could prove it, adultery (is he living with another woman, for example)

The process will take 4 to 6 months, possibly a little longer.

No, I'm not a lawyer, but I have been through it myself (not recently, thank goodness!).

Getting a resident card might prove difficult. On what basis are you currently in the U.K. anyway? Are you sure you are not already illegal?

A general comment is that in the west you usually need to file for a divorce in the place that you live, so you cannot file in the US if you don't live there. I don't know about Thailand - were you married in Thailand?

A final comment is that you need a lawyer. Quickly.
