My son has dual citizenship (American and Thai) he is 20 months old.

He has an American Passport but not a Thai one. He does have a Thai birth cert and is on a house hold reg..

I have taken him to America once before, and left on his American passport. He had no entry stamp so i didn't worry about an overstay.

I will get him a Thai passport... but do i have to before i take him home for xmas. He is currently with his mom and i wasn't gonna see him until the day i take him to the states.

If he leaves on his American passport again will he get hit with an overstay fee?

If your wife is traveling with you they normally will exempt kids from under 7 years old for overstays if with a parent (Thai).

If you are going on your own then bring his birth cert. along and you should not have a problem but a Thai passport along with the USA passport is what works easiest for us.

My son and I will be traveling alone.

That may increase the chances of a hang up at immigration leaving or returning. I already have purchased a plane ticket for my son and his mom to travel to BKK the day before (domestic) my son and I depart for America. So it would be more convenient to wait to get his Thai passport until a later date.

Your son should leave Thailand on the passport he entered Thailand, the US one. When returning from the US enter on the Thai passport.

He will not be fined an overstay, children are exempt from overstay.
