is there legal action they can take? or is it just that you'd burn your bridge with that employer etc?

i wouldnt worry, an employeement contract means zero in thailand anyway.

lets assume 3 to 4 years... would that make a difference?

It depends upon what your contract says. In the section where it calls out the requirement for 3 months notice, are there any words such as "or pay in lieu of"?
