Instead of closing the thread, lets have a civil discussion about it...

We know for a fact that an underage female student being shagged/raped by a male teacher could face serious psychological problems afterwards and possibly later in life.

My question is: Would a male student suffer similar problems, or will he not?

This is an excellent and very brave question. Unfortunately, I am embroiled with enough controversy for the day so haven't read further, lol. However, legally, she should be treated like anyone else.

Whether she does time or not, the law is the law. A lot of people would say a suspended sentence might be appropriate, but with this kind of situation, it has to be emphasized that were the sexes reversed or the same, the cries for a custodial sentence would be deafening. If it was my kid (male or female), I would expect a custodial sentence to be just.

I suspect that she will do time.

You don't send people in jail for violating teacher-student trust, and that's what's going to happen to her.

Resignation, reputation - this is the kind of punishment for that.

29yo woman having sex with a 13yo boy is illegal, right. But if we put the law aside for a moment - who says it was the first time for the boy? Who can prove that the boy hasn't been sexually active already. Should we try and put all those hookers who took his money in jail, too? The society encourages boys to go out and "explore", there's no stigma of any kind attached to it. He could have bedded his classmates, and I don't know, maybe 30% of boys are sexually active before the legal age of consent.

Does partner's age have any adverse effect on his psychology? Is it better if he seduces a 13yo girl instead? For this boy - is shagging a 13 year old girl legal but, say 18 year old, is not?

I, frankly, can see enough options to have a reasonable doubt he had experienced any kind of trauma and become a victim.

Law is the law, if it's illegal then it's illegal, but it doesn't always make it right.

This country has some big moral issues, he is going to suffer with this for a long time.

he doesn't really know how to manage the thoughts about having sex, plus it was with a teacher, he has let down his family, his teacher has been arrested for being with him, and now that everyone knows who he is they will be staring him down and making him feel like something is wrong with him.

I feel sorry for him, in the next 6 months this is really going to hit him hard.

Lots of comments such as 'lucky lad' and 'wish it was me' etc. What would be the comments on this thread if the teacher was a 29 year old farang male and had sex with a 13 year old Thai girl? 'Hang him hi', 'cut his balls off' etc etc.

Amazing how the attitudes seem to differ when it's an underage schoolboy having sex with an adult who is in a position of care and responsibility...

Actually, you're wrong; there is a big difference, and in Thailand, that is both in the law and the culture. There are no laws that provide for the rape of boys in Thailand. Furthermore, a 13-year-old girl would be stigmatized for the rest of her life which could relegate her to commercial sex work, especially after sex with an older foreign male, but a Thai boy will not.

In the West, it is also obviously different both culturally and factually, but for legal reasons, it must be treated the same under law.

Given that boys/men become inundated with a virtual overdose of testosterone at around 12-13, and a bit earlier women begin menstruation, one can't help but contemplate when precisely it is that nature intends humans to begin having sexual intercourse.

Take away cultural prohibitions, religious proscriptions, parental apprehensions, societal restrictions, and psychological misinterpretations, and it becomes clear that at about this age boys and girls are infused with a healthy, normal, and natural desire for sexual intercourse.

In this case, however, there is clear abuse of the teacher-student professional relationship. The age differential is also questionable.

Yeah - have to agree with this position (to coin a phrase). Go back to our own cultures far enough and this is definitely true - physical responses to our changing stages of life, for the most part of our history, comes way before any superimposed religious or secular morality defined by a few and forced on the rest of us until it becomes the norm.

I think it's the case where men and women are clearly unequal. Why should ten year jail sentence be imposed on a woman? Just in the name of equality? How ironic. If women want gender equality then they should do jail time like a male would. Somehow I think that's not the equality feminists usually envisage for their liberated brethren.

Laws should reflect society's attitudes, what the society finds acceptable and what is not, and the degree of punishment.

Yes, I agree with you about the laws in this case being out of sync with Thai society (* or shall we say majorly hypocritical).

However, gender equality also means gender accountability, and in a lawful society there is no excusing the abuse of Teacher/student minor abuse regardless who is doing it. There are inherent contradictions in both, but I prefer to live in a society where people understand the law and are responsible for their actions, regardless of gender.

But, are there differences in gender and the rate and experience of sexual development, and consequences of seemingly similar experiences? Absolutely.

With 14 (yup FOURTEEN) it was ME who turned a number of guys into pedophiles - because it was ME who did the seducing bit in lowly places such as the train station toilets which were a hangout for gays AND skater kids like me at that time.

Has it done me any harm? Not that i'm aware of. I knew 100% what i was doing and darned i loved every minute of it.

Of course had any of the men i seduced (or i myself, for that matter) spoken a word they would've gone straight to jail. Because laws are made by people who have little imagination and forget that this is the 21st century - thanks to the internet, these days kids know everything about sex before they know how to spell "condom". It's not like the parents still tell them something about birds and bees at age 14 and expect them to wait another 7 years to learn the truth.

I personally am pretty fed up of every day reading some headline about some "sex" related "crime" somewhere. Don't they have anything else to report then just "sex", "sex" and "sex"..??

i think it is okay that those people who make the laws, the ones who have only little imagination and forget that this is the 21st century, make some laws that punished situations where adults met 14 years old kids in train station toilets to have sex.

there are a lot of pedophiles around and thats why there is a law, to protect kids from abuse. even it was for you okay and no problem. it's not a relationship of equal power, a underage person lacks experience, knowledge, judgement of what is 'right' and 'wrong', is much more weaker, and defenseless if the adult exercise a power play, easy for him to be in control, to get the kick on his ego trip.

there is nothing wrong if kids play and try it out each other with partners from the same peer group. dosn't matter if the partner is of the same-gender or the opposite. and they need education about it, how to play safe, how to prevent STD and to prevent pregnancy, because they are to young/dumb to be parents. those education maybe should be also a little bit moralistic and not to much hedonistic, focused on the lust factor of sex, but teach them that "love" also means responsibility and respect for the partner.

yeah it's the 21st century, train station toilets are the hotspots of mature interaction and kids can watch all kind of porn on the internet and the bodies of 14 years old are maybe biological ready to practice all forms of love, but not their brain. and humans as social being have developed something more than only to follow carnal desires. and it is not religious voodoo or catholic anti-pleasure madness if we keep some tabus and teach kids something oldfashioned concepts like romantic love instead of only f*cky s*cky fun just because they grow some hair and their biological system now produced certain bodily fluids.

i am not christian or uptight, but 13,14,15 years old are still kids, should go to school, learn something and should not hang around train station toilets frequented by older men. that is not a good playground for them.

and what have you in mind when you got fed up that (a particular form of) sex get related to "crime"?

Sorry Kat, but you are wrong. Since the amendments in the Criminal Code of 2007, both men and women are seen as equals in regards to underage sex/sexual harassment etc...

Sorry Kat, but you are wrong. Since the amendments in the Criminal Code of 2007, both men and women are seen as equals in regards to underage sex/sexual harassment etc...

I used to work in a UK College before coming to Thaland. We once had a case where a female lecturer was having sex with the boys aged about 16 so legal. However one student threatened suicide and became very depressed after she moved on to another conquest. Eventually she was sacked for gross conduct but was given a reference allowing her to get another job in a Schcol where no doubt she carried on with even younger victims. The idea that all males are immune to mental damage wereas all females are not is clearly ridiculous.

Yes, agree with this wholeheartedly. However, to believe that the effects will be exactly the same across the board in a reverse gender scenario is also ridiculous, especially in later teenage years. However, I think we can all agree that adults have no business abusing a teacher/student/minor relationship, with no exceptions.

Leave them both alone, they were just doing what comes naturally.

A suspended sentence would be appropriate for the woman as the law must be observed. Nobody appears to have suffered from this apart from the circus which is now happening.

I'm of the same opinion whether the genders were reversed. Provided there has been no misuse of authority and free will has been respected I'd say that the age of consent could be lowered to 13 without any affect on society other than preventing the shaming and criminalisation of people who don't stand to hurt anyone apart from themselves.

When I was at school 13 year olds always wanted to shag their teachers and a few lucky boys did. My sister told me it was no different at her girls school and a few of them got lucky as well. No harm done as far as I can tell. For some reason it wasn't something which was talked about much even when we knew it was happening. Guess we just didn't think it was a big deal.

I would also stress again that teacher-student and adult-minor relationships should be separated here to avoid confusion.

About unequal power in relationship mentioned by Permanent-disorder - that would be true if the teacher tried to seduce the student, not the other way around. Not all 13 year olds are equal. For some it would have clearly been abuse of desires and urges they are not fully aware of and over which they have little control, for other 13 year olds it's - "Keep up the good work man, you clearly know what you are doing."

The boy could be six feet tall, some 80-90 kg, not exactly a baby.

The law tries to draw the line equally, with the same cut off age for everyone, but people's development is unequal. At 15 some are still clearly open to all kinds of abuse, even if by law they are not minor anymore.

This really puzzles me.
Parents of the 13-year-old, who was big for his age group.

Why would they even say that? Because he was big it means she didn't know (She was tutoring him) or because he was big it makes it OK?

Maybe they are trying to say his little dinky is bigger than a pinkie?

Please can anyone explain why or what is the point other than trying to make less of an issue out of it.

There is no such thing as consensual sex with a 13 year old and I find some of the comments made here by members really appalling. Think back when you were 13 and how you thought you knew it all but now you can say WOW I didn't know sh@t, well now put that same scenario in a room with a predator and surely you can see the manipulation scenario.

This will hurt him in the short and long run especially in this culture, he will only be know as the boy whom was raped by his teacher regardless if he wanted to be with her or not, even if he wants to try to wear it like a badge.

I am a teacher and I know it is many a 13 year old girls fantasy to consensually bed a handsome teacher.

Girls are more mature than boys at that age so she should be able to handle it better.

I don't get this debate. The law is there to protect younger children from predetory adults. Rape happens here daily and children are often victims, that is one of the reasons the law was amended to give equality to the sexes. Whether or not many posters here would have loved to have shagged their teachers in their early teens is irrelevant as it is illegal in most civilised societies for adults to have sex with minors. There is such a real and very vadid reason for this law. It protects children. The teacher knew better, she acted wrong and broke the law. Why should she not be punished? Just because she lived your teen fantacies does not give her an escape from knowingly breaking the law. And don't say she thought it was OK. The fact that she claims she resisted shows that she knew it was wrong. It was illegal. The Thai law can not make loopholes to satisfy your fantacies. It was put in place (and recently changed to cover male rape victims) after years of lobbying by people who have worked with rape and abuse victims and also by those have experienced it. The boy may not be traumatised (hearing about his boasting, he probably wasn't) but the teacher broke the law. Its like drugs. If I enjoy drugs recreationally and dont harm anyone it still doesn't mean that it is illegal. It is. And if caught then I would expect to face the law.

I've made my arguments in this topic concerning the mental development of 13 year olds, and thus their ability to rationally consent to sexual relationships with adults or each other, but they now need to be repeated.

It's one thing for two teenagers to have sex with each other - though even then, in a lot of cases some issues surface later in life (not just sexual issues)- than it is for a mature adult to have sex with a teenager. It's harder for teenagers, especially at 13 years old, to separate reality from fantasy and to comprehend the outcome of their actions. In reference to the boys "size," remember that physical stature and mental development are not synonymous with each other. A 13 year old boy might be 6'3 with a 12 inch penis, and a 13 year old girl might have d cups, but that does not mean they are consenting adults. However, it is also proven that while using emotional information differently than females, males naturally seek different ways of coping with trauma; this is especially true in regard to how males act towards their environment. This is why men in adult hood are often more prone to developing abusive behavior towards people or animals, alcohol dependency, mixed views about gender, authoritarian complexes, sexual deviancy, and the list goes on and on and on...

This idea that males are somehow immune to certain things needs to be reexamined along with views about gender.

If you rationalize adult-minor sexual relationships on the premise that because young people are able to have sex with each other, often without immediate consequences, its okay for you to have sex with them, you need to seek help and possible treatment. If you show destructive behaviors towards either yourself or others, you need to seek help.
