Hello all,

I am married to a thai national and we have a daughter aged 2 1/2 years old and our daughter has a British passport now. I had been living in Thailand for the last 5 years with my wife and then our daughter for the last 2 1/2 years. I have had a house built for us before our daughter was born but still with plenty of room for us. Also i am only aged 32 years old and my wife is 30 years old.

I have had to come back to England due to the financial situation now. And now i am staying with my parents.

My questions are and hopefully someone can give me decent answers are :

1: My parents live in a big 5 bedroom house will this suffice as a place where we will settle ?

2: Do my parents need to be a co-sponsor as i live with them ?

3: Do my parents need to show all docs from when they bought house 34 years ago ?

4: What visa could i go for to bring my wife home with me ?

With the financial side for applying for a visa me and my wife have no savings we have our house and land. My wife has no job as she looks after our daughter full time. I have some money in bank but British embassy stipulates that my wife has money in bank for something to come back to.

5: I would just like some sensible answers to my problems if anybody else has been in my shoes and overcome these hurdles ?

Thankyou for your time and understanding,

Paul

Question 1: 5 Bedroom house should be more than enough, the only problems I think could occur is from your parents loss of space, but if they are fine with it then no problems.

Can't answer the rest sorry.

1: My parents live in a big 5 bedroom house will this suffice as a place where we will settle ?

Yes, providing that there is at least one room for the exclusive use of you and your wife and another for your daughter.

2: Do my parents need to be a co-sponsor as i live with them ?

No, you will be her sponsor. They should, though, write a letter briefly describing the accommodation and inviting you and your family to live with them.

3: Do my parents need to show all docs from when they bought house 34 years ago ?

No, but some form of proof that they own the property will be useful. I assume that after 34 years the mortgage is paid off, so a copy of the deeds or similar.

4: What visa could i go for to bring my wife home with me ?

A settlement visa as your wife. This normally lasts for 2 years at the end of which she applies for indefinite leave to remain.

(*However, as you have been married for more than 4 years she can apply for ILR immediately she has satisfied the Knowledge of language and life in the United Kingdom requirement. This may not seem important, but the government increase the cost of ILR each year by way more than inflation, so the sooner she applies the better.

If she has already satisfied the KOL requirement on a previous visit to the UK, by taking and passing the LitUK test for example, then provided you show this to the embassy she will not be granted a settlement visa, she will be granted indefinite leave to enter instead, which is the same as ILR.

*Edit. Have you been married for more than 4 years? It's not clear from your OP.)

I have some money in bank but British embassy stipulates that my wife has money in bank for something to come back to.

Whoever told you this is wrong, she does need money in the bank in Thailand to come back to; she is moving to the UK to live!

Even if she were only visiting she would not need money in a Thai bank, although for a visit visa it could be useful.

Just for clarity on this thread, I believe 7by7 means she does not need money in a Thai Bank if she is intending to settle.
