I've heard of a few accidents for example.

a man drives on a road in his pick up and a drunk motorcycle driver hits the car head on on the cars side of the road, the result is obvious the motorcycle driver is dead.

but later on the family of the dead man comes to the car driver and that to claim 200.000 bath.

he only pays 50.000 but it is not even his fault. and this is amoung THAI people in Isan.. not farang.

what is this for regulation of that payment. have any of you heard of this or experienced it? it seems so unfair that a victim of such an accident should pay for the others mistake, the motorcycle driver was drunk and drove himself dead... why does it have to go over the wallet of the survivor who was not the guilty one?

I have also talked with my gf about this, she said it has to do with moral or something with pity... i still don't really get it..

Does anybody know an answer to this?

I never killed anybody but I've already been involved in an accident with a motorcycle taxi. We called the insurance, they sent a guy, we all went to the police station and they solved the problem between them. We didn't have to pay even one Baht !

My wife was also involved in accident with a taxi, a car this time. Same, she called the insurance and they solved the problem.

Added : Not sure if it makes a difference but both time it was in Bangkok city.

The driver of the pick up was either drunk himself or had no insurance.

Have never heard of a Thai parting with money in a situation like this unless they had to.

If you ever find yourself in a similair situation, admit to nothing.As mentioned by previous poster, let the insurance rep take care of it.

Yes, it is a common thing for the poor family to seek help from a well to do driver that kill or injure a love, his/her fault or not, best thing have insurance and call this PRONTO if you have an accident. Nothing legal or not legal about the family seek help, but some tend to be over zealous :o

A teacher in my village was involbved in an accident where in someone was killed. She offered the family money to help them, although it wasn't her fault. The family wanted more and went to court. The court decided it wasn't the teachers fault, so in the end nothing was paid.

Part of your insurance “no fault” should cover if someone is killed. It may get a bit more complicated if is your fault. But if is not your fault, the insurance should cover up to 1000,000 bth
