My friend is a single dad, American, his son stays with him here in Thailand.

His non-imm. b visa expired and his 7 day extension ended yesterday, he was unable to get an extention due to a major screw up with paper work. So he would like to fly to Hong kong, get a tourist visa x2, return to Thailand a few days later. He does not want to bring his son along (would remain here with nanny and friends) I'm guessing this would cause major problems.

so my questions are:

Does the Thai embassy in Hong kong give out double entry tourist visas? I've heard some places are easier than others..

Does anyone foresee difficulties in getting a tourist visa after overstaying 1 day in Thailand? chance of application denial?

Any idea of what would happen if he goes to HK to get a tourist visa but his son remains here? His son has an American passport, American parents.

I realize these are questions more suited for an immigration lawyer but I thought I'd post here anyway to get some feedbak.

Hong Kong is not a good choice they do not issue 2 entry visas and will want to see a ticket out of the country for even a single entry. For a 2 entry Vientiane is about the only confirmed location in the region.

A one day overstay is not a problem. If flying out they give a 24 hour grace period.

I don't think anybody would even know that his son stayed here. It's a personal problem not a immigration problem.

yeah, i checked some posts about HK, doesnt sound good. I actually just got a 2x tourist visa in Vientiane so im trying to convince them to do the same.

as for the dependent, the next time to father leaves with his son, they will see that the son never got a tourist visa, so they could view it as an overstay...either way, i'm thinking it will create major problems down the road..

I just called Siam legal and they said the son would absolutely have to accompany the father.

A child under 14 does not pay an overstay fine. He can sort out his sons visa later.

No comment about the lawyer.

Children are not fined for overstay, not deported for that fact. Of course it is always better to keep everything legal, but some immigration officers will advise you to just let your son here on overstay.

Note that if the child goes to school in Thailand he can get an educational visa and his father can stay in Thailand as his dependend when he can show 500,000 in a Thai bankaccount.

Also, about the following I have a question.....

Mario, were you stating that the son can get an educational visa if the father has 500,000 baht? Or, that the father can get some type of visa if hs son is in school and the father has 500,000 in the bank??

The objective for my friend is to get a long term visa. He does not need to work in Thailand, but can part of the time, which helps sponsor his business visa (he is under 50 and not married). He would prefer not to have to go through all the hoops of a business visa and the requisites, accountants, taxes, but it has seemed the most stable way to go for him as an under 50 American living long term in Thailand with his son.

Does anyone have any good ideas on a long term visa that doesn't cost as much in incurred costs (like company/income/empoylee taxes) for a single American parent and child ?

Ok. For what he found out, the child is welcome to stay in Thailand, since he is under 12 years old. Once the father secures a business visa the child will get a visa stamp valid for the same period. So, in this case, the Thai give some leniency for childrens' requisites.

Children are not fined for overstay, not deported for that fact. Of course it is always better to keep everything legal, but some immigration officers will advise you to just let your son here on overstay.

It's a 2 step process. The child needs to be enrolled in a school and get a an extension of stay for that. Then the father can get an extenion to support the child if he has 500,000 in a Thai bank for 30 days.

This means the child would need an ED visa from a consulate or embassy using paper work from the school to get it and at the same time the father would get a non-o visa as the parent of the child. Then when they both are within the last 30 days of their visa entries the child and father could both go to immigration and get extensions.

See 2.11 of this police order for the fathers extension which will give you the clause for the child.

His child should obtain an extension of stay for education under section 2.8 or 2.9 of police order 777 (pinned items). He can then obtain one year extensions of stay under 2.11 until child is age 20, or married, or moves out. He will only have to show 500k in Thai bank account each year for 3 months.
