Divorce In Thailand

Featured Replies

I am about to divorce my thai wife. we have agreed on everything so hoping its just a trip to the amphur. Does anybody know if you have to surrender your marriage certificate. I heard that your visa can be withdrawn too...is this correct? I wish to stay in los and my non imm visa expires end of July and am planning to renew in KL as I did last year. Any comment or advice please.

You will bothy have to show up with the original certificates. Not sure about the visa depends on what kind of..

Hi,

Re visa. Yes. Can confirm you lose your visa the day you divorce. The very day. It happened to myself when I divorced at the amphur. So, best plan would be to hop over the border before you divorce and come back on an entry visa. Then complete the divorce.

If you have children and you have custody you can obtain a visa on that basis. Otherwise you will have to use tourist visa, or business visa if you have a job.

And yes, of course you have to surrender your marriage certificate to the amphur and you will be given a divorce certificate.

Regards,

GFL.

I was divorced last September and had a valid Non O based on family and friends. I never lost my visa and it was not even mentioned.

You have to take your original Marrage certificate to the Amphur and you will be issued with a divorce certificate.

Many thanks for your info. Sounds like I will have to renew my non o in Kl before the day and hope they don't ask for it back. And why should they, they are not immagration.

If you are on an extension of stay based on marriage to a Thai, your permission to stay in thailand ends the same day you divorce, maybe even sooner when you no longer live together as man and wife.

If you are on your original 90 days after entering with a non-O visa or if you have a valid multiple non-O your permission of stay remainds valid, but you can't get an extension of sta.

You might need to bring witnesses for the divorce.
