i've always assumed that the family members of my fiancee included on my spouse visa will have a limited amount of time to come to australia, once the visa is granted. is this correct?

i.e. say if we get the spouse visa next month (july), will my fiancee's family members (listed on the application form) also be granted a visa at the same time (and thus required to travel within a specified time)? or, can they just be listed as a form of assurance towards a family visa application some time in the future?

it's just that i'm not confident my fiancee's family are ready to move to australia just yet (language and skills barriers, no passport or id papers are just a few things that will make it difficult) when we both travel to australia on the spouse visa. i would be delighted if they could relocate to australia in the future, but will listing them on the spouse visa app now mean that they will be able come later down the track? is it advisable or more difficult to just submit a family visa application when we've been living in australia for a few years, when they're more prepared to come?

I think you will find it much more difficult if you do a seperate application at a later date.

I think you will find it much more difficult if you do a seperate application at a later date.

so if i put their names in the current visa application, what sort of timeframe will they be given for being able to travel to australia?

You really need to do your homework some more with regards to what members of the family unit (MOFU) can be included as secondary applicants on the primary applicants spouse visa application.

they're not really in a position to travel to australia for at least another 5 years. that should be enough time for us to locate them from australia, and sort them in making prepations for them to come.

You need to visit http://www.immi.gov.au/ it will tell you everything you need to know.

I just brought my wife and son to Australia. I think you will find it very difficult to bring siblings and parents permanently to Aust.

From the Immi website, only dependant relatives can be included on the primary application

Dependent children

A person is your dependent child if they meet at least one of the following requirements:

•they are your natural, adopted or step child

•they are under 18 years of age

•if they are aged 18 years or over, they have been wholly or substantially dependent on you for a substantial period (at least 12 months) for their basic needs (food, clothing and shelter) and the reliance on you is greater than any other person

•if they are aged 18 years or over, and they are wholly or substantially dependent on you because they have a total or partial loss of their bodily or mental functions that stops them from earning a living (whether or not they migrate with you).

Note: If your child (regardless of their age) is married, in a de facto relationship or is engaged to be married, they will not be considered to be a dependant.

Dependent children may, in some cases, be added to your application after it has been lodged.

Other dependent relatives

A person is your dependent relative if they are one of the following:

•your parent, brother or sister; step-parent, step-brother or step-sister; grandparent, grandchild, aunt, uncle, niece or nephew, step-grandparent, step-grandchild, step-aunt, step-uncle, step-niece or step-nephew,

and all of the following

•not your dependent child

•single, such as a widowed aunt, etc.

•usually resident in your household

•wholly or substantially financially reliant on you for their basic needs such as food, clothing and shelter

•reliant on you for a substantial period (at least 12 months)

•more reliant on you for that support than on any other person or source.

If the relatives do not meet the criteria then a different application will be needed to completed, If the relatives meet the above criteria but will not be migrating with the primary applicant the relevent application will have to be completed prior to their migrating.

So to answer the question.....if included in the application as migrating with the primary applicant....then only those indicated (by ticking the boxes in section D) as such will be considered for a visa. Any other family members will be required to apply separately.

Generally all the applicants on one visa application travel together.....I am not sure how it works with travelling separately....however all the applicants will have a time limit to enter Oz by.....usually 12 months from the embassy's receipt of the first application document.....the clock ticks from the day that the embassy receives the first bit of paperwork for the initial application. If they havent travelled by that date then the visa becomes void for that person
