In some research I am doing on the Fart East some of the countries are more

concerned with drugs than underage sex.

Time somethinng was done about people trafficking.

It has to do with Uncle Sam because under US law any American citizen can be prosecuted for illegal sex with an underage person ANYWHERE IN THE WORLD under American law, even if the same thing is legal in the foreign country.

These convictions have occurred.

This means, Americans need to be aware of US law AND the laws of the country they happen to be in.

Unless I am very much mistaken the actual anti prostitution law introduced in the late 1990's, I forget the exact name of it, (though I have read it due to the number of false ID cards used by the girls)) states that paying for sex with an under 18 year old is a crime only if it takes place 'in a place used for prostitution'. or words very similar. I've always taken it to mean either a brothel or a shot time bar with rooms upstairs etc. I've even know police tell short time bar owners to make the under 18 year olds (but 15 or over) go to the farangs hotel in which case no prob.If this chap gets prison time purely for paying a 16 year old for sex in an ordinary motel then I will be very surprised. Maybe they caught him on some other charge, taking obscene pics or whatever. I think a great many farangs will be watching this case. Not because of any wish to go with 16 year olds but because often the 16 year olds buy false ID cards saying they are 18 or even 20. And its not always easy to tell how old the girl is by looking at her when she is covered in makeup, especially after you've had more than a few Singha's. I've never heard of a farang in prison for just having sex with a 16 year old. Has anyone else? I'm sitting here in England and I can go out and tell the nearest policeman I'm going to bonk a 16 year old (no thanks) and he'll tell me thats fine. Thats how most of the world is if you bother to find out. Of course, if Thai law states its 18 in Thailand then thats the law and thats fine but Thais can bonk each other at 15 as far as I know and usually money changes hands anyway. The chap was a bit stupid though taking a girl in school uniform to a Sukhumvit hotel, thats really unwise one would have thought. Though girls in Thailand seem to go to school until they are past 20 dont they sometimes so maybe she had a false card anyway claiming to be 18. What happens if she showed him a false ID card saying she's 18?Is that a defence for him or not?Though I'm still not clear on what law he's broken. U.S. travelers who book trips to countries that are hot spots for child prostitution will begin this month to see ads, brochures and billboards warning that sexual adventures abroad could land them in prison here.

The warnings, written and distributed by religious organizations, child-welfare groups and the federal government, are a sign of a new assault by the Bush administration on the international child sex trade. They also reflect a new law intended to catch U.S. residents who engage in or promote sex with children overseas.

"People assume they can go out of the country and get away with exploiting children in this horrific way," says Mike Garcia, assistant secretary of the Bureau of Immigration and Customs Enforcement. "We're sending a message. We have the power to (arrest them), and we have the will."

In the past six months, U.S. authorities have arrested two men from Washington state who are accused of having sex in Cambodia with underage boys, and an 85-year-old Los Angeles man is accused of trying to fly to the Philippines for sex with two preteen girls.

Another man, Richard Schmidt, 61, of Baltimore, arrives in the USA today to face charges that he traveled to Cambodia and the Philippines for sex with children. An indictment unsealed Wednesday charges him with molesting eight boys. Schmidt, a former teacher, has been convicted three times of molesting children in the USA. He was released from prison in July 2000. Schmidt fled to the Philippines in June 2002 after Maryland authorities issued an arrest warrant for parole violations, U.S. Department of Justice officials said Wednesday.

Investigators from Immigration and Customs Enforcement have more than 20 other cases underway, including 11 American men who were arrested by Mexican authorities and are awaiting extradition.

Effects of new law

The arrests were made under a child-protection law President Bush signed April 30. It includes a provision that U.S. law enforcement officials say gives them a new tool to prosecute hard-core pedophiles and "sex tourists" who want to engage in sex with children.

Although it had been illegal since 1986 to go abroad with the intent to have sex with someone under 18, prosecutors say the crime was difficult to prove in court. To get a conviction under the new law, prosecutors do not have to prove that U.S. residents left the country specifically to have illegal sex — only that they had illegal sex or tried to do so.

The law doubles the penalties to a mandatory 30 years in prison for each offense. Authorities can use it to arrest owners of travel Web sites and travel agencies that promote sex tours or arrange for clients to have sex with children.

The law was a result of pressure on Bush and Congress from conservative religious groups to be more aggressive in fighting the sexual exploitation of children worldwide.

The administration has joined with religious groups to promote the crackdown. And it is getting help from groups with missions in countries where the sex trade is rampant.

Child-advocacy groups estimate that 2 million children worldwide are working in the sex trade. The Internet is rife with tour companies that pitch travel for legal prostitution and make veiled references to sex with children. There are chat rooms in which participants discuss the best locations to find the prettiest girls, the cleanest rooms and the cheapest prices. And the Web allows people to make arrangements to travel to countries, such as Cambodia, Thailand, Costa Rica, Mexico and the Philippines, where child sex is plentiful and law enforcement has been lax.

One destination is Svay Pak, a small town about 7 miles outside the Cambodian capital of Phnom Penh. There, about 30 ramshackle brothels line the streets.

Joe Mettimano, director of the child sex tourism prevention project for World Vision, an international Christian relief organization, visited Svay Pak last year.

"I got 5 feet down the dirt road and I was approached by a young boy asking if I want young girls. He said, 'I can get you 9, 10 years old,' " Mettimano says. For an hour, he observed men going in and out of the brothels. "You hear very distinct Australian, American and European accents."

World Vision is one of several organizations working with the U.S. government to devise pop-up ads on travel Web sites, posters and pamphlets in airports, and billboards in destination countries that warn of the new penalties. World Vision has received a $500,000 State Department grant for its part of the project.

Because hard-core pedophiles may not be deterred by the ads, they serve more as a warning to "sex tourists." These are the "businessmen and holiday travelers who see the sex trade happening all around them and decide to experiment," Mettimano says.

"Some of these men actually believe that when they go abroad it is acceptable and that they are helping poor people support their families," says Carol Smolenski, executive director of End Child Prostitution, Child Pornography and Trafficking of Children for Sexual Purposes USA. "If you are really concerned about them, then just give them money and don't ask for sex."

Joint enforcement efforts

Travelers who fail to heed the warnings could get nabbed overseas in a joint enforcement effort involving missionaries, social workers, local police and the federal government. Employees and members of charity and religious groups overseas watch for Americans who engage in sex with children. They will turn over names, photos and other evidence to local police, who can arrest offenders and turn them over for prosecution in the USA.

When Cambodian authorities arrested Gary Jackson, 56, of Bainbridge Island, Wash., in September and accused him of having sex with three boys under 16, the charges were based on evidence collected by a social-service organization in Cambodia.

The Cambodian government turned Jackson over to U.S. authorities on Nov. 20 after a federal grand jury in Seattle charged him.

Jackson's defense attorney did not return phone calls. Jackson, who was convicted of a sex offense in Washington in 1981 and sentenced to 10 years in prison, is being held in jail until trial in March.

This means, Americans need to be aware of US law AND the laws of the country they happen to be in.

I stay in dozens of Thai hotels every year and have noticed in many of them signs up somewhere that clearly state that if anyone brings a person of LESS THAN 15 YEARS OF AGE back for sex he is liable for prosecution. Fine, I have no prob with that, anyone bringing back a kid deserves all they get but my question is this. Can those signs be taken at face value or is there a law not mentioned by those signs that would clobber you if you brought a 17 year old back for a night of nookie? The hotels are being very misleading if they cannot be taken at face value. Many many Pattaya hotels have those signs up somewhere or other. Curious...

I am all for busting the kiddie-fiddlers and punishing them severely, but articles like this make it out as if Westerners were overrepresented among paedophiles. Much research suggests that this is not the case. Other nationalities seem to lack the need to drag out their trophies in public though.

I agree with eye of sauron on this. intersting is that Chiavacci in roman dialect of italian means "######er". he's probably from rome and definitely is a ######er. I've heard of a book called "the damage done" by a guy that spent more than 10 yrs in a thai jail over opium traffic and douring this time the most terrible shit happens to him. stuff like prisoners put into a bamboo cage that is then attacked by an elephant. after a while the elephant gets bored and crushes the cage killing the poor inmate inside. a treatment like that surely wouldn't be legal but a baseball bat up the ass might be an option.....naughty boy..... :o

Not discussing the morality of this issue, just that as an American, this guy will likely be deported and spend 30 years in an American jail. We have to be more careful than most Westerners. Did you notice that the US Embassy was involved in the arrest.

I think all 'at-risk' Thai girls should be married off young as first and second wives to farangs and hopefully that'll give them a proper start in life.

If given the choice I'd rather marry my 13 year old daughter off to a westerner than keep her till she's 19...only so she can marry a Thai. At least with the westerner she'll one day be a 19 year old with some options in life...

Canada has included in its Criminal Code provisions that allow for the arrest and prosecution of Canadians in Canada for the sexual exploitation of children in foreign countries. Convictions carry a penalty of up to 14 years' imprisonment. Many other countries have passed similar laws.

In addition, most foreign countries are vigorously enforcing existing national laws to combat sexual exploitation of their children within their borders by foreign visitors. Harsh penalties such as long prison sentences - and, in some countries, the death sentence - are imposed on offenders who sexually exploit children.

The Canadian Criminal Code provisions relating to child sex tourism (sometimes referred to as Bill C-27) came into force on May 26, 1997. The Canadian Criminal Code now asserts extraterritorial jurisdiction for the following offences relating to sexual exploitation of children:

sexual interference

invitation to sexual touching

sexual exploitation

anal intercourse

making, distributing, selling or possessing child pornography

indecent acts/exposure

prostitution of a person under 18 years

Hey Guys,

Can we get a little perspective here ... we are talking a 61 year old MAN having sex with a 16 year old CHILD for MONEY. In what way, shape or form is this possibly correct? We are not talking an arranged marrage in some African Congo, we are talking a 61 year old MAN having sex with a 16 year old CHILD for MONEY. At what point is this OK?

So now some of you are denying your Western Roots and saying ... hey, this is OK, the Thais do it all the time, why is this such a big deal, why can't we do the same? Well, take a look at your skin ... are you THAI? Where were you born? What were you taught? Oh, no, it is OK because RICH Thais do it, and they get away with it. Wrong is not wrong because some people, or even many people, get away with it.

And ... now don't take this too personally, because I did not look into your histories ... but I will bet that some of the people saying "hey, this is ok, because the Thais do it all the time" ... I bet that some of you are the same people that complain and complain on this website about the "illogical, irrational, overemotional, underemotional, moronic" things that Thai people do. You are right, just a generalization ... but I have read enough of this website to see that there is more than enough complaining about how the Thais act ...

Well lets sum this up a bit. First the guy wants some companionship to escort him around thailand. True to form it is legal here. No problem. Secondly a girl says pssssssss to another girl that she got hot farang wanting companion for some fun, so she introduces her to him and connection made. Now this second girl having been paid a few times to take care of her bills, has a little fun with oldie and then one day someone knocks on the door and ahhhhhh, both are in heat with the sweet smell of sex coming from the door to the outside, and then they see oldie and youngie together. So how did some authority know what was going on in this different motel room.

Well, either (which is most likely exactly what happened) the motel manager got pissed off seeing this oldie got a nice hot lass with him, and jealous of his manly intelectual skills etc, calls the police and says hey I got some hot oldie playing hookie with a youngie here in my motel. So now, Police come over, and gives the tipper some generous amount of Baht for his hot tip, and they even know the room number!!!!!! Nice huh. So who is the snitch, yep the motel dude.

So now they know he American, they go to US Embassy and get a background check done, and presto they find out he got a checkered past, so now the police get involved a bit deeper etc, and hit him with porno pics and underage sex and now the American finds himself not only dealing with the Thai charges but also knows the American charges are pending once he gets deported and the rest is the whole 9 yards following.

Its quite simple here in Thailand. Rule Number ONE: Don't walk inside any motel or hotel establishment with a young girl beside your side unless it is truly your daughter or some real relative. Your stupid if you do. Rule Number TWO: Don't take pics of any of them period. Rule Number Three: Don't pay them direct in CASH!!!!!!! Keep your hands CLEAN.

Last of all, keep your mouth shut and don't brag of your exploits. The less said the better. Thais like to keep face and they have an honor system within themselves, so do the same for them.

I agree that the girls here in Thailand think your totally insane for wanting to have sex with someone closer to your age or even 18 or older, when there is plenty of young girls under 18 all around to take a dip here and there. IT IS MANDATORY THAT ALL THAI CITIZENS MUST HAVE A THAI ID, and the vast majority of them do have some Drivers License since they ride motorcycles all the time. If she is 18 or over, your on safe grounds, no problem and you can definitely enjoy yourself. If any girl cannot provide those two essential pieces of ID, drop her like a hot potatoe!!!!!!!!!!------No MATTER WHAT THEY TELL YOU, DROP THEM PRONTO. Don't feel sorry for them or cave into their excuses, PROTECT YOUR OWN SELF.

ALL THEIR FILM!!!!!!!!! and burn it right away. Don't worry if it being another sightseer, or they making themselves look like they are tourists themselves cause THEY ARE NOT THERE doing some sight seeing or touring themselves. Understand. Simple as that. That camera film is obviously their evidence against you of whatever it is your doing etc, and their means to ID you through their offenders database etc, and such will be used against you later on as their proof in Court.. Also look for any notebooks on their possession, and take it away from them, and DON'T HAND ANYTHING BACK TO THEM CAUSE IT HAS YOUR FINGERPRINTS. That is their Diary of your activities to build their case against you. Also it is evidence against you.

This part is what I can gather on how the holy and thou groups do their dirty work to others and make your life miserable from notes and news clippings over time.

The legal Age for consensual intercourse in Thailand is 16, when there is approval

of the immediate family, however Laws exist which are in effect but not always

enforced to the nature of cultural and regional laws.

The crime committed was the purchase of sex for money, especially at that young age. Thailand merely wishes to convey the fact that this type of behavior is not to be tolerated. It reflects on the society as a whole and is meant to be a deterrent

to current issues with young people looking for alternative income.

As for my opinion, if anyone wishes to hear it; there is no excuse for sex abuse.

At 61 years old there are places to go where the girls are young looking and not

so innocent. We don't know the entire situation here but obviously it appears to

be a case of abuse of circumstance.

As for the laws of Thailand, it is illegal to pay for sex in any case, regardless of age. Although we all know that law is fortunately not enforced to any great extent.

Westerner or not, there is such a thing as common sense and also HYSTERIA.

I personally feel there is a good bit of HYSTERIA in American culture over the issue of adults having consensual sex with minors.

The law is the law and must be respected, or expect to suffer the consequences.

However, that doesn't mean thinking people need to believe that the HYSTERIA is in fact warranted.

For example, does it really make sense that the penalty for consensual sex with a 16 year old prostitute should be tha same as the penalty for "interfering" with a 10 year old child. They are very objectively different crimes, yet the law doesn't see it that way.

The following 26 US states (more than half) have age of consent laws permitting hetrosexual sex with people aged 16 (in a couple of these states the age of consent is less than 16):

Additional laws restrict commercial sex. In Georgia the age of consent is 16 but sex outside of marriage is illegal for all ages (a misdemeanor).

Additionally, the following states have split age of consent laws which say that whether or not the woman is able to give consent depends on the age of the male who she's giving that consenting to (the right hand number is the age of consent regardless of the age of the male, so Iowa could be added to the 26 states above):

Now due to Federal statues, it is illegal for any of the residents of any of these 27 states to have sex with a 16 year old in Thailand. There are also (federal) laws that apply when someone crosses state lines for sex.

Note also that the above only applies to heterosexual sex, the laws governing male-male and female-female sex are a further mishmash, illegal in some states and having different ages of consent in others. For example, according to the source (though I find this difficult to credit) it is illegal in New Mexico for an adult male to have sex with a 16 year old girl, but it is legal for him to have sex with a 13 year old boy.

My reading of the 'involvement of the US embassy' is that this 61 year old convicted sex offender was on the US national sex offender registry, and when he traveled to Thailand the US immigration authorities assumed he was going to break this US sex-tourist law and asked the US embassy in Thailand to put pressure on the Thai police to "get him" for something. I do doubt that the US officials went so far as to set him up with this "friend" of his guide. It seems more likely to me that the man put pressure on his guide, or simply indicated interest, and in order to smooth the situation the guide got her friend to "stand" in for her; a friend she knew was no innocent virgin.

In Brazil, a 16 year old girl is considered a woman and you wouldn't have this kind of fuss.

The situation in Asia is different as it now has the reputation as a child-sex haven so the spotlight is focused here. Plus, the girl had on a school uniform which compounds the issue.

Still say the prick should be locked up though. Lots of 18 year olds running around... :o
