Overstay

Hello there,

I am Indian citizen on non immigrant ed class

my visa non immigrant ed class expired on 8 march 2005, the reason was I applied for australian visa on 20th january and i was told it will take about 7 to 10 days to process. But it took 50 days to process and I just got my australian visitor visa on 9th march. By the time I got my passport back from Australian embassy my thai visa has already expired. I am leaving the Kingdom on 15 march for australia and I have two choice regarding my visa one is to apply for extension of my non immigrant ed class visa and second is just to pay fine upon leaving the kingdom at the airport on 15 march. But I will be back on 15 may so I will need a new visa. 1.Will this affect my visa application if I did not report now and just pay the fees on departure? 2. If i report to immigration now ( i have 14th march) and ask for extension of my visa will it be done in one day or how long will it take? If it takes more than oneday i know i cannot wait for that as Im leaving the kingdom on 15 march. Also , will this leave a mark in my passport that i break immigration rules? I really hate this because australian immigration also asked me question about my payment of fines after i forgot to do 90 day report. I really dont want more negative marks on my immigration history.

Any suggestions is welcome..

thanks for the reply. Like I said the reason i'm overstaying is because australian embassy was in possion of my passport from 20th january -10 march. I am scheduled to apply for extension on february but I cannot because my passport is not with me. I am overstaying only for 4 days now and maximum 7 days after which I am going to leave the country in anycircumstances. I am asking will it be better to report to immigration on monday (14th march) or pay fines upon leaving the country on 15th march.

To HumbleFlyer, I dont need many passport, one is morethan enough for me and no I don't learn how to work and I am not allowed to work here. Indian embassy has nothing to do with this issue.

I know I cannot apply visa in Sydney so I'll have to go back to calcutta from australia and apply fresh visa there if I cannot extend my visa on monday.

Why on earth did the Australian Embassy keep your passport for that length of time? After all, you may have needed it to exchange money or book into a hotel. Everyday things.

Also, it's always a good idea to keep photocopies of the relevent passport pages. At least you could have produced them at immigration and looked willing.

Reckon your best bet is simply to pay the overstay and reapply in Calcutta. An overstay stamp dosn't look good, but in my experience, one won't cause too much trouble. Do it regularly and it will.

PS, I might see you there tomorrow. I'm going up with a doctor's letter to try and explain away a 24 day overstay.

You can apply for a Thai visa in ANY country. Why do you think everyone goes to Laos or Penang to get their own visa.

I would show up at Immigration Suan Plu, with your reciept from the Oz embassy. 'Extanuating circumstances' are accepted. I had to overstay a few days a few months ago, but the police report i provided was enough, and they were all appologetic. First time anyone at the immigration department ever smiled i think.
