I live in kanchanaburi for 7 years and i am under thai wife visa (o-a i think) with work permit for 3 years now.

i run a compagny here.

I am divorcing with my wife and everything will be finnish on november, my visa will expire on 09 october . i need a new one non"B" i guess? under my compagny.

My question is that must i go out to malaysia (penang) to get the new "B" visa? or can i go to immigration and change my actual visa for a "B" one?

In case that i have to go to Penang, wich document must i bring with me?

PS: My ex wife and me have a child 17 month who is thai citizen, i don't know if that can have importance with my visa.

You do not need to get a new visa, instead when your extension of stay expires you go to immigration and ask for an extension of stay based on your business.

(I don't think you have a visa, but an extension of stay which you extend every year).

You can apply right now. You don't need to wait till the last day of your current permission to stay, the extension will always start from the day cour current permission to stay ends.

You will almost need the same documents as is needed for your work permit.

having a Thai child is also grounds for an extension of stay and you could try to get an extension based on that. But you are not divorced yet and they might want you to have sole custody over the child. Income requirements are the same as for marriage.

Thank you for your response, so if i understand i just go to immigration like every year and apply for a new extension of stay but this time don/t need my wife support, just my buisness support?

Maybee i should go to BKK immigration because in Kanchanaburi they are a bit lost in these law i think....

My son will stay with my wife ....

Agree with Mario as long as you meet the requirements for extension of stay based on employment (through your company). Requirements being minimum 50k salary/month for westerner (but depends upon nationality) and ability to provide 2 years audited accounts and tax returns. If this is a problem you will have to obtain Non-B visa before your current permission to stay expires if you can't get extension of stay based on Thai child before your divorce is finalised.

You must use the office assigned to the place you live - you no longer have the option to use Bangkok.

Thank you for your response,i will try to ask again tomorow at kanchanaburi immigration if they will allow me to do that extension and ask them to enquiry in BKK office if they don't know...

After the divorce you must have 4 employees.

I have 4 (i pay for the PAKAN SANKRUM) so that will be ok, for the tax and income my accountant will arrange this i guess.
