My Thai wife and I want to take her child from a previous relationship with a Thai national to Australia.

The problem is the child doesn't have a Thai passport yet and the Aussie visa requires her father to give permission to leave Thailand.

That said, we can't find him and the only information about him apart from his name was an address on the childs birth certificate where he lived more than 5 years ago.

Is it possible and how do we go about getting some document that only requires my wife to give the ok (presuming her ex is still alive)?

Note: the father shot thru after the kid was born and has not been heard from in 5 years. Not even a baht...

Any help with this would be much appreciated.

we just did the same thing for my wifs daughter to come to the uk....you have to go to the district office were your wifes daughter lives and get some paper work signed by the officals (ill attach the doc needed(show your wife)...)...we had to get somebody with a bit of clout in the village to sign a stat dec to say my wife had sole responability for the girl.....a lot of fathers in thailand cant be traced so this is a fairly common thing

If you can't find the child's father your wife can go to her local Amphur and get a 'Kor Bor 14' then take it to the Thai Passport Office where they will issue the child's passport with just your wife's signature. My wife's cousin went to Australia with her daughter about two years ago and she thinks the Australian Embassy accepted this instead of the father's signature when issuing her daughter's visa (she didn't register a marriage with the father at the Amphur though).

A Kor Bor 14 is a declaration and history of who has had custody and responsibility of a child during it's life. Your wife will have to take to witnesses with her (including somebody like a 'village elder', teacher or police officer if possible) who have known your wife for a number of years and can confirm she has custody. She can use family members as witnesses if there isn't anyone else available.

Incidentally, for UK husbands wanting to take their wife's children to the UK, if there's no official document determining custody from a divorce for example, the British Embassy have currently been asking for this document as part of the custody and responsibility proof. In their declarations the wife and witnesses can state both the custody AND day to day responsibility for the children, and day to day responsibility proof is important when applying for a UK visa. Just remember that both the Thai Passport Office and the British Embassy require an original, photocopies aren't acceptable, so ask for two at the Amphur if needed.

Thanks for your replies, they have been helpful, however, have raised a further question.

My wife and I are currently in Australia awaiting a decision on a temp spouse visa so she is unable to front up at eithor the Amphur or Thai Passport office. We have the Aust Embassy sorted as they are aware of our situation.

I was hoping my wifes parents can front up at the Amphur with the childs Birth Certificate etc and get the job done.

Note: the child was born in BKK and has never lived in my wifes village in Ubon, so we don't have any village elders, the childs house book etc.

Is a Kor Bor 14 still attainable?

It is my understanding that the mother must appear at the application centre with at least two witness who must also complete the PK 14 document.

I have looked at the various websites and spoke to my wife who has been through this previously and can see nothing to suggest there is any other way.

However I would suggest you contact the Thai Consulate in your State and put the question to them.

Good advice, maybe we can meet with the Thai consulate in Sydney who can verify my wife's ID Card and Passport before faxing the Amphur in BKK.

I'll let everyone know how it turns out next week.

I believe your wife will have to go in person, along with her two witnesses, when she applies for the kor bor 14 at her local Amphur (where her ID card was issued). At least, I know of somebody who had to return to Thailand from the UK to get this document to enable her to take her son and daughter to live in the UK with her and her British husband.

Just have read your post and I wonder if you could give me some information about bring a child to uk( my son ) he live in thailand with my mom and he's 10 years old ,I will traveling back to Thailand in Jan to get him a settlement visa to come here and live with me but i not have much idea about it ,seem like you and your wife have an exprerinces about how to get done?I have been living in uk for 3 years and hold leave to remain & i have passed ESSOL classes and waiting for my son to joint me ILR when he's here next year ,I've also got a job as a postwoman which is secure & regular employment. If i apply online do i have to visit the visa centre, & which visa do i have to apply for. Also is there any useful tips you could give me that could help with this application. I appreciate your help with this thank you Numtymail.
