While trying to help a friend concerning his first application for a 1-year retirement, I came across this in the pinned section - from Maestro's Laws Regulations etc. - regarding retirement application 2.22;

"(6) For an alien who entered Thailand before October 21,

1998 and continuously allowed to stay in the Kingdom as a

retiree, the following shall apply:

(a) He/she must be 60 years of age or over and has regular

income. His/her bank account deposit shall not be less than Baht 200,000 a year and evidence of the account deposit for the

previous 3 months must be shown; or he/she has a monthly income"

Am I misunderstanding (not difficult for me with visas), or does this mean the old grandfather rule, dropped a few years ago, has returned?

My first 1-year application (Marriage visa) was in April 1997, whereby I obtained 9 months to add to my 3 months from arrival in January. Since then I have renewed each year, originally on Marriage Visas then for the past few years on Retirement visas.

Does this mean that, being aged 69, I now only require to show 200,000 per year?

The grandfather rule was never dropped - but marriage did not get grandfathered when it changed. You do not appear to have been here as a retiree since 1998 if you were previously using the marriage option.

Yes, that's what I was afraid of, but hoped that 13 years coming up of 1-year visas would be acceptable. To be honest, when I first applied for a Marriage visa, I didn't even know the Retirement visa existed.

Nothing lost in trying. Sometimes people do get things that would not seem possible and you are at an age where they usually try to be helpful.

Thanks again, and a good point. I'll take a trip to Phibun long before the great day and ask them where I stand. They have always been very helpful there throughout my 13 years, so it's worth a try.

Hello Davyboy - sorry to say that the ruling strictly applies only to people receiving retiree visas since before October 1998. I didn't really expect any other answer, but there is always a hope that some immigration offices will accept variations, so it was worth a trip to Phibun - nothing ventured, nothing gained eh?
