Divorce Based on Mutual Consent

Are there Thai mutual Divorce Agreement forms (with an accurate translation in English) or even a combined Thai/English that I can view or even download.

This is a translated copy I received a while back. I believe there are books in English on Thai Law available that have both Thai and English versions of Thai documents.

DIVORCE AGREEMENT

We………………………………………………………… the two of us have lived as husband and wife legally and have registration of marriage at …………………………. Province………………………………….Registration Number……………………… Dated ……………………………….

Now the two of us have certain reasons that we can no longer live as husband and wife. Therefore we would like to dissolve our marriage with the following conditions.

Item 1 Regarding the children (List all children and amount of child support) …………………

Item 2 Regarding the Alimony (In the case that the woman is requesting alimony) ...........

That may be good enough if you don't have kids but beware if you do. It says absolutely nothing about custody which means that both have 50/50 custody according to Thai law. Doesn't say anything about who decides residence, who decides school etc and that means that any parent can just take child, change residence and school and the only thing the other parent can do is to sue for sole custody if not acceptable. You could be asking for trouble leaving it as open-ended like that

MikeyIdea the above posted is a translation of the blank divorce agreement form The blanks are filled in as required by either the parties filing for divorce or their legal representatives.

I haven't worded what I wrote very well, apologies. The form is excatly what you say

I am just giving the advice that if you divorce in Thailand and have children, then it is advisable not leave it open-ended like that when it comes to residence of the kids etc.
