I need some advise and information.

My husband employed by a thai company since last year and we moved here as a big family. Beside me (wife) and our 2 kids we also brought our nanny from home. Few months ago we all went to immigration office at Chaeng Wattana for obtaining 1 year stay permit. Each of us has similar paperwork. for our nanny in addition to a letter from the company, also a letter certifying that she's our dependant issued by Indonesian Embassy. All of us (include the nanny) coming into thailand with Non-O visa. Everybody but our nanny got 1 year stay permit.

Could anyone advise us why this happen? We sent our nanny back to Jakarta to apply another Non-O visa and the officer at Thai Embassy consular persistence that she should be able to get 1 year stay permit. Her last Non-O visa will be expired very soon and we are hoping to keep her here instead of sending her back to Jakarta like before.

Your nanny is not considered one of your dependents under Thai immigration law. Only immediate family members are. Thai immigration won’t extend her visa.

There is nothing to stop you hiring your nanny, and obtaining a work permit etc for her, but this requires you to go a different route, and as she is probably not earning enough to qualify for a 1 year extension, will probably have to leave the country every three months and renew her permit. Forum sponsors such as Sunbelt have a good trackrecord in helping other members in this process, which is quite common for Philippine nannies who work here.

As said she is not your dependent.

She has to qualify for Visas in her own right.

Whether she is eligible for a Work Permit I am not sure.

As Samran said she will probably have to leave every 3 months.
