Visa And Work Permits

Hi,

We are a consulting engineering firm in Queensland who have won a contract to help a Thai company build molasses storage tanks in Bangkok. We have sent 2 workers from Australia who are paid by us to help and supervise the works to be completed. We have now employed an Australian Citizen who is currently in Thailand to supervise the completion of the works. Unfortunately his visa has nearly run out so obviously he needs to get it renewed. After several phone calls etc which have just added to the confusion we still do not know how to go about it. Does he need a work permit? What is the best type of visa to get for him? Where is the best place for him to go if he needs to leave the country to obtain the new visa? Your help would be greatly appreciated as after so many different stories we are not sure what to do next and we need this matter resolved urgently.

Yes he does need a WP.

Penang is the easiest destination.

How long will he need to be in Penang to get it all finalised? Where is the best place to go? I'm sorry but I dont understand why he needs a work permit when he is working for an Australian company who will be paying all his expenses and wages?

Your visiting Australian engineers - being paid backn in Australia - can get by with non-immigrant visas, and an "Urgent Work Permit" - good for 15 days.

If your Australian who is based in Thailand is receiving payment in Thailand, then he does tevchnically need a conventional work permit. To get a work permit, he needs a Thai employer - not an overseas employer.

Under negotiated arrnagements, I could temporarily hire your in-country guy to work as an employee of my company - and my company effectively becomes the Thai sub-contractor of record to your company. This would all be completely legal - we could give him an employment letter to take to Penang, he obtains a non-immigrant visa, and enters Thailand with a 90 day entry permit. We then get a work permit for him- 'takes about 10 days, and work permit would be valid until the end of his 90 day entry permit. My company is presently capitalized at sufficient level to sponsor one additional foreign work permit.

My company's core business is providing incorporation services - including processing work permits and entry permit extensions - so we could handle all the necessary administration in-house.

You pay us, we pay his burdened salary. I presently have three (increasing this month to four) Thai employees who work in support of overseas companies, but for whom my company serves as employer of record. We can also do this for short-term foreign employees.
