February 16, 201016 yr My Thai wife has two boys, 13, 15yrs, living with her exhusband. Middleclass area Bangkok. Could someone tell me what would be an appropriate monthly maintenance payment to help support the kids. (ballpark will do) Thanks.
February 16, 201016 yr This thread will give you that information, if you are talking amout alimony for children and not divorce agreement that is The formula is based on age but it doesn't vary much, we are talking less than 4,000 bath per month and child and father cannot be made to pay unless he legitimized his children http://www.thaivisa.com/forum/Friends-Cust...re-t337923.html Edit: Didn't see that children lived with the father, the mother is always legitimized and should provide support in this case
February 16, 201016 yr Legitimization is not necessary, a mother can file a paternity suit and based on that get child support for the children. But that is not at issue in this case. What the law requires and what would be fair can be something different. The payment is for the children, not the ex-husband, and to give them proper care and education.
February 16, 201016 yr Legitimization is not necessary, a mother can file a paternity suit and based on that get child support for the children. But that is not at issue in this case. Mario2008, the lawyer told me that the father cannot be forced to pay maintenance before he is made legitimate, are you sure?
February 16, 201016 yr What I'm trying to point out is that legitimization does not have to start from the side of the father. The effect of a paternity suit is that the identity of the father will be established, in effect legalizing him. That is of course not the same as him getting parental powers, but does have its consequences for child support (and entitlement to inheritance). See http://www.thailawonline.com/images/thaici...l%20code%20.pdf page 18. The action for legitimization does not have to originate by the father.
