Legitimization is not necessary, a mother can file a paternity suit and based on that get child support for the children. But that is not at issue in this case.

What the law requires and what would be fair can be something different. The payment is for the children, not the ex-husband, and to give them proper care and education.

Mario2008, the lawyer told me that the father cannot be forced to pay maintenance before he is made legitimate, are you sure?

What I'm trying to point out is that legitimization does not have to start from the side of the father. The effect of a paternity suit is that the identity of the father will be established, in effect legalizing him. That is of course not the same as him getting parental powers, but does have its consequences for child support (and entitlement to inheritance).
