I have an 8 year old daughter i would like to register as a british citizen

The material facts are as follows:

I am a non resident british citizen by birth,

the child was born in thailand and has a thai mother,

i am not married therefore the child remains illigitimate,

i am able to show a D.N.A. proving i am the biological father,

i have a court order in thailand making me the legal father in thailand,

i unfortantly failed to register the childs birth with the uk embassy before she was i year old,

because she was born before 2006 (before the law was changed) and illigitimate i am not considered the leagal father in the uk,

i have been told the only way i can get her a uk passport in to get her a dependant visa and take her to live in the uk for 3 years,

i can also apply using a form MN1 but this is discretionary.

I just wondered if anyone has been in the same situation as me and been successful in registering there child as a british citizen despite the uk's draconian laws on family and immigration

Not sure about UK law, but often there are two ways in becoming the legal father. The first way is if you yourself legitimize your child. The other way is if the mother (on behalf of the child) files a paternity suit with the court and the court declares you are the father. Perhaps this is a way for your daughter to become a British citizen.

The big question is if this is possible, now you are already the legal father of the child. But the point is that the rights of the child are in discussion here as well, not only yours. Both interests can be used and sometimes the child has more rights/options than you as father.

Note that there can be legal differences between the two ways of legitimization. Contact a citizen Service Bureau (if that is the right name) for competent legal advice about this.

Is you name on the birth certificate as the father?

A mate of mine had a similar dilemma as the British Embassy would not issue a passport as he was not married to the mother but he was named as the father on the Thai birth certificate.

He flew them all to UK, marrried the mother and applied for a passport while there.
