My Thai mother in law is buying a room,

She is buying it over 5 years, I would like to think that there is some guarantee, some paperwork involved so that after the 5 years she gets the lease, I would like to know if you are in a room and you buy it what guarantee do you get, I have thought about taking her and the paper work to a Thai solicitor / lawyer, What sort of service could i expect if they know there is a falang on the seen , has anybody else on Thai visa done this sort of thing, any help would be great full Thanks in advance.

I'm sorry, could you explain that?

If she's buying something, why would she get a lease for it?

What is the room? An apartment, or condo?

rent don't buy, then no worries about being ripped off.

How much will buying this room cost?

Rental of a small Thai house is about 1000-2000bht a month (village-town)

If a white man is financing the purchase you can bet the price will be a lot higher.

Sorry I will try to explain again , My Mother in law is buying a room in a building, Its a standard room, lots of Thai people live in them, She is classed as old at 55, So she wants to buy a room so that she can live in rent free when she retires, She works at the local hospital, I do not want to see her get ripped off buy some scam, The deal is that she can buy the room over 5 years . and at the end of 5 years paying she will own the room. I want to make certain that after paying for the room what is actually hers, that's where my question comes in , if I went to A Thai legal person and got him to look at the papers would I get some good answers or just strung along because I am a falang, also has anybody else had a similar situation. Hope that makes things a little more clear.

1. Is this a government housing apartment or is it a private apartment? My Thai girlfriend's parents (both now deceased) bought a Thai governemnt apartment some years ago...but I don't know how much they paid for it. If it is a government housing deal, I would say it is legit and you shouldn't worry. I believe it was transferred to my girlfriend's older sister when the mother (last survivor) passed away last year.

2. Since I don't know if you are male or female I don't know if if it's her son or daughter that you are married to. Anyhow I'm sure that he/her will have a definate opinion about mother-in-law buying the room. Ask him/her if he/she thinks it is a good deal. If he/she says yes, then I would go along with that.

3. Failing all else, ask the mother-in-law...politely and respectfully...about the details/cost/will she own it later/etc. If she asks why, try to politley expalin that you want the best for her and you are a concerned in-law. Remember she is older than you, so be respectful, but questioning. You are just a dutiful in-law, trying to make sure mother-in-law is treated well. That's your angle.

The closest I can think of to this situation is the way Thai people buy shop houses on leased land. The banks won't lend against the building so the Thais sign an agreement to pay the seller over a period of time.

The agreement is registered with a government department. I'm unsure of the department. At final payment the shop house is signed over to the buyer.

I've personally seen this happen twice and know of other instances. I haven't heard of an agreement being broken so far.

I notice the OP mentions "That once a fa(l)rang comes on the scene everything changes , that is only likely to happen if he finances the purchase , I have noticed that Thai do not scam Thai in these sort of deals , so , is he looking after the finances ?

I do not know how long you have lived in Thailand or how much you know about Thais , With respect , Thais scam Thais more than falang, They rip the poor off because they can. Also The room, or any repayment is nothing to do with me , I care for my wife and mother in law because they are good people and after all they are my family, Not all Thais who are above 40 have had any education because women where encouraged not to got to school,and the men where trying to make a living. If It was anything to do with me I would not do anything until I have seen some paperwork, and guarantees from a solicitor/ lawyer.And I would have paid cash, one time payment. I Am standing in the back ground and watching, Because my mother in-law is proud, although poor, She would not , and will not ask me for one bart. Hope that satisfies your Enquires Sherlock.

Unless it is a condo and this does not sound as an official condo she cannot own anything. The best she could have is a lease and I am not even sure that a lease could be registered at the land office for a room. It would just be a simple contract.

Not sure I understand what MIL is up to. It's not a straight purchase. And these days, you all should open your eyes or drive around Pattaya, across the rail track. See how many new homes are VACANT. In our condo village, rents have been falling and shops and other business keep closing. Times are terrible and real estate is a bad investment.

Time share sales people tried to sell me a 1/26th of a condo in Pattaya available on the free market for about 20,000 Baht per month for EUR 10,XXX plus only some service fee of EUR 163 per week. One trick was the claim that one could rent out one's condo at something like EUR 100 a night. Yeah, right.

Our place requires about 150 months when the HOA fee is taken into consideration. some deal, huh? By then, the poor build quality will lead to maintenance costs... And don't get me started on the lack of insulation or better windows. Energy seems to be free - nobody cares whether a few thousand baht for better windows would be saved very quickly.

Thai friends bought a new home and had to give it back due to countless serious defects.

You all might find out that your landlord is happy to give you a 10% discount. check it out and don't catch a falling knife, figuratively speaking.

Well , I seem to have gotten some-ones knickers in a knot over a very simple question that was pertinant to his post for help , I lived in Thailand long enough to have some idea of how the Thai operate and I am aware they are terrific scammers that are versed in the art from birth , I in no way encircle ALL thai in this , I merely speak of what my own personal experience was . Sorry if I touched on any sore point you have , but believe me that was in no way my intent . It was a pertinant question and you could quite easily responded without being so testy , good luck in your endeavors to be the nice guy .

My reply to your reply, Was done in jest not because I was testy, I think humer can get lost in translation, thanks for your input.
