Foreigner Divorcing Foreigner In Thailand

Featured Replies

Hi, just want to know if the usual Thai/farang divorce rules apply for a farang/farang Thai registered marriage? Most of the information governing divorce in Thailand I've found relate to Thai/Farang marriages - what about if both are farang?

Any information would be greatly appreciated

Not sure, but probably possible.

One of the requirement might be that you both actually live in Thailand for a certain time already. Suggest contacting isaanlawyers/thailawonline for real legal advise.

Cheers for the contact info - will ask there.

Just a little unsure as I've read somewhere that if both parties are foreigners, different criteria might apply - I'm wondering whether they even have to get divorced in Thailand or whether they do this via their embassies.

Also I'm not sure if they can fulfil the criteria of being resident in Thailand. The marriage is typical of the ever popular destination wedding scenario: two foreigners coming to marry in Thailand and registering it at the Amphur as well as their respective embassies. Now in the event of divorce, will the Thai courts have/or want to have jurisdiction given that they're both foreigners?

I don't understand that subject's relation with the Samui Forum. Moved to general.
