my husband (american), he have a thai son who is currently living in sukothai with his thai uncle.

his mother, we found out that she is not in thailand anymore (living with her bf abroad).

my husbands fault is he didnt get any copy of his sons american passport and the report of birth abroad.

we want his son who is 11 years old to come and stay here with us in philippines.

now to make my story short, we have some questions that hopefully somebody here can help us.

1. where he can get a passport? is there a office in sukothai that he can go to or he needs to go to bangkok?

2.what are the requirements? both parents are not in thailand

3. is there a chance anybody here would know somebody that can help him to get a passport? an agency maybe

please help

thank you very much.

7 days in visas and migration to other countries without a reply, and I don't think Thai visas etc. is suitable either. So moving to General where you may get the answer you are looking for.

You said: "my husbands fault is he didnt get any copy of his sons american passport and the report of birth abroad."

Do you mean that the boy DOES HAVE an American passport and Report of Birth Abroad? And the problem is that your husband just does not have them with him?

If so, I'd think that these could be traced via the U.S. State Department.

This is just my own opinion, but I have been through something similar (here in Thailand) about 10 years ago.

I think the Thai passport agency will want to see some authority of the mother (or a person who has legal charge over the boy) before they will issue a Thai passport.

Even if you can get a US passport for the boy, taking a Thai child out of Thailand (even a child of dual nationality) could cause serious problems for your husband, if the mother (or a person with legal charge over the boy) has not agreed to the boy leaving the country.

It might even be regarded as 'kidnapping'.

If the uncle has legal charge over the boy, and agrees to the child being handed over to his father, it may be that the local Courts will issue an order transferring the child into your husband's sole custody.

The sole custody document makes everything much easier (and legal), but you will need a lawyer to help you get it.

If he is serious about wanting custody of his son, your husband should get legal advice as soon as possible.

Good luck.

1. What does the boy's birth certificate say about his nationality.

2. If both parents are not present it will make the issuing of a passport difficult.

There are regional passport offices. Not sure for Sukothai.

I think you need a local laywer to guide you through this.
