Ok I will try and explain this as best as possible, I do apologize if some details are vague.

My current gf is married to an English guy, they signed the papers at an Amphur in Bkk. They got married early this year but have since split up, my gf would like to get a divorce but the guy is digging in his heels and said he won’t for 2 or 3 years. He is currently residing in England and does not and has never lived in Thailand for a sustained period of time.

The main question is, can she obtain a divorce without her husband’s approval, or is it something she can only do after a certain period of time?

Again apologies for the vague information as im not sure what details are needed exactly.

Operable paras:

* A 3 year period of separation

* One spouse has deserted the other for over one year

If your spouse is not present or will not return to Thailand to contest the divorce, you may still be able to proceed provided that he or she has been given adequate notice of the divorce action. Service must be applied through a Thai court if your spouse is not in Thailand and substitute service, (such as by publication) may be allowed in certain circumstances. If your spouse does not respond to service from the court the divorce case may precede based on default.

Hiring an attorney is probably good advice but proceed with caution; a situation like this may look tempting for attorneys/officials bilking the "farang."

It is also my understanding that untill legally divorced she will be unable to purchase land (possibly other assets) without signed permission from spouse. I could be wrong about that but I think there is something to it.
