If you are Thai, I guess it will not be a problem. If farang then there probably will not be room enough!

Up to 6 or 8 is common, not all seated ,though. But they squash in. Makes for very cheap travel.

Yes, it depends on the individuals' sizes, adults vs children etc.

I assume OP means the classic Bangkok tuk-tuk. There are different tuk-tuks in different parts of the country and even in different parts of Bangkok.

Or you could go for a stretch-tuktuk:

Southern-style tuk-tuks carry six or more just in the back.

Phuket tuk-tuk

These can also be found operating in Bangkok, especially around Phrom Phong, but they are not red and considerably older and less well maintained.

These are not Tuk-Tuks, they are song taos, 4 wheels, 2 rows of seats. Tuk-tuks have 3 wheels. Song taos come , in size from little suzukis, as in your photo, to 5 ton trucks.

Songtaew, converted pick-up or larger, ply specific routes picking up and dropping off passengers on demand. The red vehicles on Phuket are smaller and individually hired, like their three-wheel Bangkok equivalents. They even shout 'tuk-tuk' at any likely-looking passer-by.

It is, though, a question of whether you are classifying on appearance or function.

Not all TukTuks are the same. In Kamphaeng Phet you sit infront of the driver.

Sorry I was not too clear in my OP. I meant if 3 at the back is legal or not. I gather it is legal up to any number of people unlike the motorbike.

I'm sure there's a law as to how many people can be carried, but I doubt its ever enforced.

I've seen as many as 7 passengers in a traditional 3 wheeled tuk-tuk in Chiang Mai. 3 tourists is also very common. But if you're farang and try to get more than that, expect the driver to charge substantially more, or charge on a per person basis.

If there's a law against the number of people on a motorbike, I've never seen that enforced in Chiang Mai.

For us foreigners 4 incl driver in a tuk tuk ,5 include driver in a Taxi and 2 on a motorbike.

For locals 14 incl driver in Tuk tuk, 12 include driver in a Taxi end 9 on a motorbike.

When they asked him if it was safe, he answered my father did, i do it and my son is going to do it, mind your own business .
