Do you have the chance to appeal a vaf4a visa,

I am not sure that our case will be strong enough as -

we have both been living in Thailand for the last 7 years so I do not own a house in the UK but have funds to rent/ make a deposit.

'Unmarried partner' GF does not speak English- saw a recent thread about it now being necessary to take an English test in Thailand.

Can provide photos of us together since daughters birth, but not very many, can prove we have been living together for the last 3 years or longer if necessary

Daughter has UK and Thai Citizenship, so the question is if we make a slightly weak application, and it is refused will it go into an appeal stage, like tourist visas to the UK?

I saw your post yesterday, but today I see there are still no replies

don't like leaving you out in the cold... like here in UK

anyway, from what you have said, you are worried your GF's settlement visa application may not get approved

well, there are many factors involved, but no-one can tell you if you'll succeed, you just have to research all the things you need to prove and get your submission together

if after all that your GF's application fails, you can always consider an appeal, but if the denial is based on facts that you cannot alter, this may well be a waste of time and £££

Hamish I like jonzboy don't want you sitting in the cold I think you will have to address the main reasons that could result in a refusal It would appear that you are in a good position regarding your relationship

the things you will have to attend to are accommodation and funds to sustain you and your family without recourse to Public funds So a job offer, And a offer of accommodation would help your case considerably

If you could secure these I don't think you would have much difficulty. But these are high up on the list. So sort them out and you are in with a fighting chance

as for the English test I think it is very basic your partner should be able to sail through it if she has been speaking to you a little over the last 7 years

The Op said his g/f doesn't speak English. If he has been conversing with her mainly in Thai and a bit of pidgin English for the last 7 years, it's doing him no favours to suggest that she'll "sail through" a test at A1 level, and it's a hurdle that has to be jumped before the visa application process even starts. Is she capable, for example, of making a phone call in English to enquire about a job, or booking a hotel room? Or listening to a 100-word news report or article and answering questions about it? These are genuine examples of what she might be faced with in a test. If he has any doubts he should get her to try an online test or go to a language school to assess her ability and get her up to the standard.
