Hi

i have a thai g/f,we are thinking of marriage,her visa was refused to come and check out my country in australia for holiday, even though i had all the necessary paperwork in place,her visa was refused as she is a low income earner,even though i sponsored her and showed proof of my bank accounts. Does this sound normal

How long have you known her?

Did she show a reason to return, employment? property etc...

Did you supply sufficient supporting evidence photos, emails, letters.

Did you show proof of your income, they dont want to know what you have in the bank, they want to know how much you earn.

Not being nosy but these are all important aspects of a good application.

i have known her for two years, visited her three times,yes she has property in thai and works for government,supports daughter, and no did not show copy of income agent did not request,she provided receipts for some gifts i brought her

Not being nosy but these are all important aspects of a good application.

Fifty percent of the applications I do these days are prior refusals. Poor applications submitted that simply fail to satisfy the genuine visitor criteria of the Migration Regulations 1994. The Form 48R by itself simply does not allow the applicant to put forward a solid application to DIAC. Supporting documentation is essential. The lack of with see an application refused.

Most of the letters of support that I see (from previous refusals) are rubbish too. A good letter of support will always cover the following:

1. Sponsor Personal Circumstances - (employment, living arrangements in Australia, savings etc).

2. Background - How long has the applicants known the sponsor.

3. Invitation - The support that the sponsor is prepared to offer the applicant too (financial, accommodation etc).

The key to a good letter of support too, is to back it up with supporting documentation. For example, if you state that you are employed by XYX Pty Ltd, then include a letter from your employer. In short anything you put forward in your letter of support, back it-up with supporting documentation. That is what gets an application across the line.

Lastly where many applications fail (i.e are refused) is because the letter of support provided by the sponsor does not show that at best a moral obligation exists on the part of the sponsor to provide the support offered. Whilst there is no legal requirement to provide a letter of support, and in fact, even no requirement to provide the support offered (subclass 676) DIAC wants to see at least a moral obligation on the part of the sponsor to provide the support offered to the applicant. To put this in two examples.

Example 01 - Possibly no moral obligation existing

Australian citizen (sponsor) meets a Thai girl online - chatted for say 2 or 3 months. Has never meet her in person, but provides a letter of support in relation to her tourist visa application. The letter of support will carry no weight as DIAC will take the view that the sponsor has not known the applicant sufficiently.

Example 02 - Able to show a moral obligation exists

With the example above, however, the sponsor travels to Thailand and has met the applicant, perhaps even a second visit. Supporting documentation must be provided to show the length of time both the applicant and sponsor have known each other. Supporting documentation can include the following, but the list is no exhaustive.

Phone records

Emails

Photos

Entry and Exit passport stamps

Receipts

One last point, the letter of support does not need to evidence a relationship, but must clearly show that a moral obligation exists to provide the support offered.
