My thai girlfriend has just returned to bangkok after a 6month stay on a uk tourist visa, it is her second tourist visa in 18 months, i wish to apply for her to return in June after 3 months back in thailand...

I know this isnt strictly sticking to the guidlines, but i wondered if anyone else has experience of multiple uk tourist visa's, or just any advice... all our other applications have gone smoothly and they have never even requested an interview with my girlfriend....

VAT1.5 Frequency and duration of visits

There is no restriction on the number of visits a person may make to the UK nor any requirement that a specified time must elapse between successive visits, The fact that a person has made a series of visits with only brief intervals between them would not, in absence of any other relevant factors, constitute sufficient grounds for refusal.

It is reasonable, however, for the ECO to consider the stated purpose of the visit in the light of the length of time that has elapsed since previous visits. A visitor should not, for example, normally spend more that 6 out of any 12 months in the UK...............

As you can see from the above, frequent visits and spending more than 6 months out of 12 in the UK are not against the rules. However, the visitor would have to show that they have good reasons for needing to make frequent visits and spend so long in the UK.

Visiting one's boyfriend would not, in my opinion, be accepted as such.

My advice is to wait until she has been out of the UK for 6 months. Even then she may have to explain why she wants to make regular visits rather than settle in the UK with you.

BTW, very few applicants are interviewed these days.

Hi I myself am in the middle of applying for a second tourist visit hopefully for 6 months too other than obviously stating visit boyfriend what would you recommend saying for staying in uk for 6 months my gf stayed 10 weeks before over Christmas. oh yeh this is a uk visit question for anybody else reading this cheers

If that is the reason for her visit then that is what she should put.

Bear in mind that as she has recently returned from a 10 week visit for the same reasons the entry clearance officer may feel that she is attempting to use visit visas to get around the settlement rules. You and she have to produce convincing arguments why this is not the case and why she will return to Thailand after the visit.

If your girlfriend is the visitor then you are not applying for the visa, your girlfriend is.

You wont IMO get a visa simple, we have recently had a similar scenario.

We advised the client not to bother it was refused on the grounds of her not spending 6 months in Thailand however you can try.

Hi I am intending on her visa starting on 1st July that means she will have stayed in Thailand 4 months this time and after the hopefully 6 months I will go back with her and then apply for a spouse visa next year with the plans on getting married and extending to the settlement visa I have put all this in my supporting evidence documentation will the ECO see this a good argument do you think? I have also put if they think that we are trying to get around the settlement visa then I am saying that 4 months will suffice. Yes your right she is applying not me but im doing all the paper work and paying all fees so it feels like I'm applying

So you want her to be allowed to spend longer in the UK as a visitor than the normal allowance so the two of you can be together in the UK until such time as you both travel to Thailand and marry when she will apply for settlement.

Well, I wish you luck; but I don't think she'll get it.

I don't think the ECO will see this as a convincing argument at all. You have already shot yourself in the foot by saying that you want a 6 month visit, but if the ECO intends to refuse the visa, then 4 months will do. Why do you expect the visa officer to be satisfied that your lady will only stay 4 months when you have already asked for 6 ? This may be Thailand, but you cannot bargain with the UKBA. Nor can you expect the ECO to believe that you intend to come to Thailand after your lady's visit to UK to make a settlement application. You would have to provide evidence for him to believe that.

My view, as a former visa officer, is that the visit application, so soon after the last visit, is an attempt to get round the settlement visa requirements ( and costs ?). This is, of course, only my view, but I suspect that the ECO will be thinking the same.

Thanks for that info both 7by7 and you I have not sent paperwork yet it's just that I don't want to be pressured into to marriage commitment to early but want to spend more time with my gf in UK.. Do you suggest I aim for spouse visa now instead and do I have to get married I'm Thailand first we have been together for 2.5 years so far and are already engaged in Thailand but I understand a Thailand engagement doesn't mean anything decinn tti

Three possible ways for her to get a settlement visa as your partner:-

Spouse visa; you need to be married.

Fiance visa: you need to show that you will marry within 6 months of her arrival in the UK, and then actually marry once she is in the UK.

Unmarried partners visa; you need to have been living together in a relationship akin to marriage outside the UK for at least the last 2 years.

You don't seem committed to a permanent relationship yet; so don't marry her just to get a visa.

You should date the visa to begin when she has spent 6 months in Thailand. The ECO will think you are trying to reside in the UK without a settlement visa. But to add she has only spent 10 weeks in the UK already, I would date the visa as above.

A fiancée visa allows her to spend up to 6 months in the UK and you have permission to marry. Once you are married you apply for a 2 year extension called further leave to remain.

The applicant must pass an X-Ray & English test and meet all the other necessary requirements.

A fiancee visa is a settlement visa. Current waiting times can be found in this link

Usually, at this time of year, the waiting times get a little longer. Last year the maximum waiting time went to about 12 weeks, I think.

A fiance visa is NOT a visit visa; it is a settlement visa.

Only apply for a fiance visa if her intention is to marry you once in the UK and then settle indefinitely.
