Visa To Uk What To Do

a friend of mine is in the uk with his wife on a six month visa,( apparently she is under 21 and not allowed a two year visa) which is up in mid august, she is now expecting a baby in 8 months time (december)

and would like to have the baby in uk but if not then no problem.

what is the best thing they can do ? , try and stay in uk or go home and try to get another visa. fyi she had one holiday visa refused before they got married

any advice greatly appreciated ..

I am assuming that she is in the UK as a visitor.

In which case bellboy is correct; she cannot legally remain in the UK once the visa has expired. She could apply for another one when she returned home, but there is a convention that a visitor should not spend more than 6 months out of any 12 in the UK, so she would probably be refused.

Also, as a visitor she is not entitled to any NHS treatment, except initial emergency treatment in an A & E department. So, were she to have her baby in the UK she would be charged full fees as a private patient.

Unfortunately, the rules do say that for settlement as a fiance, spouse or partner both applicant and sponsor must be 21 or over. Provided her husband is over 21, then she may apply a couple of months before her 21st birthday and the visa will be issued dated from her birthday.
