Hi There

Wondering if there is anybody out there that can help??

My Thai wife and i live in the UK now after she got her spouse visa in Feb, but she has a little boy aged 3 &1/2 who is still over there living with my wifes mother.

What we are wanting to do is get him a visa so he can come and live in the UK with us,

The first question is how easy is it to change his family name to mine, and what are the procedures ??

The second is how easy and how long should it take for him to get a visa for the uk??

The reason i ask is when we got my wifes visa we used a visa company and it cost over £1k and before you say it i know we got ripped off (EASY VISA PATTAYA). We are thinking about coming over for 3 weeks in Sept and we'd like to get the visa for him when we arrive but as we shouldn't need to used a visa company this time as my wife already has a visa, so i've been told it should be alot more simple.

Would you advise that we do the application ourselves ?

Can we do alot of the application in the UK prior to us leaving?

The reason we need to come in sept is my wife is 2 months pregnant and we need to do this really before sept/oct as she won't be able to fly for much longer

Just because your wife has a visa does not make this process any easier.

You will need to demonstrate your wife has sole responsibility of the child. My office did not prepare your application so I have no idea of your personal circumstances.



As for the fee you paid you was obviously aware of the fees with the particular agent. Our fees and the other sponsor on this forum are significantly cheaper than your previous agency that you used.

The most difficult part of a child visa is, as TVE says, proving that your wife has been exercising sole responsibility over the child. See SET7.8 What is sole responsibility?

This is a lot easier to do if parent and child have been living together for some time prior to the visa application and apply at the same time. It has only been a few months since your wife applied; may I ask why her son did not apply at the same time?

You will also need to show that you can adequately maintain and accommodate him without recourse to public funds; see Maintenance and accommodation.

Not sure about changing his surname; except that it is not necessary. I think that your wife can do it at her local ampur if you both do want to do it. Remember, though, that if he already has a passport then that will need to be changed too.

We have just done this and it not easy you have to get as much proof that your wife has had sole resonsibility in the upbring of her son any letter that you have addressed to her from Schools or doctors anything that can tie your wife with her son and all phone bills and emails record from the time she has been in the uk and Credit card stament to show her sending money home to look after him I could go on all day all I say is get as much proof as possable and when you have gone back to thailand you have to show that you did go and visit him and not go traveling around thailand without him and any photos of you all toghter and make sure the person lokking after him at the moment know what yo say if the embassy ring them.we got refused first time and had to appeal and have just had this overturn so very happy just booked flights to go and get her next month good luck and hope all goes well for you

I'm not a solicitor I will just give my point of view

I bringed my child with me, his visa has been accepted stright away ,I have been told the soonest you apply the better .

2 keys :

I had to get "Sole custody" with a lawyer ( as my child has the biological father's surname)

I had to prove Sole Responsability

for example in your case it could be many bills, letters or bills from the kindergarden, letters or bills from doctor,I sent many tickets from every thing I paid , a letter from your wife parents explaining

they just care after the child temporarely but they couldnt for longer , tickets if she has been sending money to the child .

A letter from your wife explaining she his the one that can care after the child

I guess the child has been living with her before she moves right?

Apart of this should present a folder similar to the one you prepared for your wife accomodation, p60, bills etc. Letter of sponsor

If the child has the biological father's surname the fathers has to sign the permission for him to travel

It looks as though my wife is going to go back to Thailand in August and start the process but we are debating at the moment if we use a company to do the visa application for us or do we do it all ourselves.

If we do it ourselves could you help with providing what documents you enclosed with the application or do you have a copy of the covering letter that you sent with it to give me an idea of what i need to do.

You've noted a lot of things already. When we did my wifes application we provided bank statements, wageslips, phone records, photographs and a letter from my employer. I'm presuming that most of the things that were needed for my wifes application will be required for the boys application.

Any help would be great as i'm not really keen on paying someone £700-800 on something that we could have done ourselves

Congrats on the visa and hope you have a great time in thailand, i'm hoping that i'll get chance to go when we get the visa for my wifes son.

Just remember having the sole custody document does not demonstrate you have sole responsibility of the child.

Many clients think because they have this document then the visa is guaranteed is certainly is not.

Sorry for the delay , we sent exactly the same that I sent for my spousal visa (accomodation, wageslips, proof of relationship ,p60 all all as you are married send the marriage certificate too )

we just add this 4 things : proof of sole responsability, Sole custody ,sponsor covering letter, and permission from the biological father to leave the Country

Sponsor covering letter:

The letter explained that we got married the date.... , that I had a child from a previous relationship and I'm the sole responsable , as doesnt have contact with the other parent that my husband will provide everything we need and he is happy he lives with us that the child has been for this short time with the grandparents but they cannot care after him for longer as it was just a provisory favor.

.

You could explain that you have been sending money in the short period the child has been separated from the mother and more .
