Thai stock watchdog clears opposition PM hopeful

BANGKOK, June 14, 2011 (AFP) - Thailand's financial market regulator said it has cleared the sister of fugitive former leader Thaksin Shinawatra of allegations she broke the securities law, boosting her bid to be premier.

Polls show the Yingluck Shinawatra's Puea Thai party pulling ahead of Prime Minister Abhisit Vejjajiva's Democrats ahead of the July 3 vote, but she has faced questions linked to her brother's finances.

In a statement issued late Monday, the Securities and Exchange Commission (SEC) said Yingluck had not breached the financial market laws with her involvement in a legal case against her brother.

She has been accused by her opponents of committing perjury in a case which saw the Supreme Court confiscate half of Thaksin's assets last year.

Yingluck, a political newcomer who has helped to reinvigorate the opposition, told AFP in an interview on June 1 that she was confident her record was clean.

"I think Thailand must be transparent. I'm willing for people to investigate me," she said.

Thai courts in February 2010 confiscated 1.4 billion dollars of Thaksin's assets for abuse of power, out of a total of 2.3 billion dollars frozen after the former telecoms tycoon was toppled in a 2006 coup.

Thai Finance Minister Korn Chatikavanij criticised the SEC's decision on Yingluck, saying it had "only tried to please somebody in line with recent polls", in an apparent reference to Puea Thai's lead in voter surveys.

Thaksin faces a series of arrest warrants in Thailand for charges including terrorism -- an accusation linked to violent street protests last year by his supporters within the anti-government "Red Shirt" movement.

Thaksin lives in self-imposed exile to avoid a prison term imposed in absentia for corruption, but is widely seen as the de facto leader of Puea Thai and Yingluck as his proxy.

Such an austere organisation the SEC, they haven't had a chairman leave for acting in a criminal manner for oh, let me see ....... 10 days?

Glad to see they gave these allegations of multiple perjury such a thorough examination.

Worth noting all the SEC said was she did not breach security reporting laws because she did not own over 5% of SC Asset.

They made no comment on her testimony, which they apparently did not believe since they did recommend Taksin be prosecuted for asset concealment.

They said the question of whether she told the truth or not is beyond their scope as the securities enforcement agency.

Exactly, the SEC has dodged the bullet that would be aimed at it if they didn't do this pre-election and yes to their incredible record of probity and honesty at the top, 10-11 days why quibble their head just resigned FORCED out by his own subordinates for cause.

And yes again,

the PERJURY is still hanging there like Damocles Sword, by a hair.

I believe they are saying out loud. "No Case to Answer" and go for it.

I also believe that the opposition is running a bit scared, with all the advertising from all media outlets saying she is in front and also the polls saying the same.

I honestly don't know who will get in, because I dont believe much will change at all. After all it's Politics and Pollies promise the world to all in any country that votes.

I hope whoever becomes the power at least tries to help the Thai people.

But the promises are usually shallow and in the end broken.

Korn: SEC misses the point when clarifying allegation on Yingluck

BANGKOK, 14 June 2011 (NNT) – Finance Minister Korn Chatikavanij has pointed out that the Securities and Exchange Commission (SEC)’s clarification on the perjury charge against Pheu Thai top party-list candidate Yingluck Shinawatra was irrelevant.

After former executive of the disbanded Assets Scrutiny Committee Kaewsan Atibodhi requested the SEC for progress in the legal action against Ms Yingluck for her involvement in the Shin Corp share case of her brother Thaksin Shinawatra, the commission recently declared that no charges could be lodged against the suspect, claiming she did not violate the law.

As a response, Mr Korn criticized the SEC for being irrelevant in its statement.

He explained that Mr Kaewsan was seeking punishment against Ms Yingluck for her provision of false testimony to the Court, rather than her share possession as a nominee of Mr Thaksin which had already been concluded.

He insisted that the commission remained responsible for clearing up this issue.

As for SEC Secretary-General Thirachai Phuvanatnaranubala who is widely perceived as a supporter of the previous government, the Minister confirmed that his political preference would not be the reason for his early dismissal.

As the SEC is a private organization, he said the Government would rather not intervene in its operation as it would be inappropriate.

Had Mme. Yingluck been labeled a "bad girl" her usual detractors would be swarming in the forums, She was cleared.

One less opportunity to spread rumour and accusations now.

I wonder if she has has decided on Ikea or Sombat's furniture emporium for the office furniture? whistling.gif

Finance Minister Disappointed with Bourse Regulator's Ruling

The finance minister speaks about his disappointment with the stock regulatory body's decision not to press charges against Pheu Thai's prime ministerial candidate for filing a false report regarding her ownership of Shin Corp shares.

Finance Minister Korn Chatikavanij, also the Democrat deputy leader, said he cannot understand the statement by the Securities and Exchange Commission, or SEC, Secretary General Theerachai Phuwanartnaranubal that his panel has no authority to bring legal action against Pheu Thai's number one party list candidate Yingluck Shinawatra for filing a false report over the share transaction related to Shin Corporation's share sell-off.

The panel ruled yesterday that Yingluck's statement that her older brother and ousted premier Thaksin Shinawatra and his then-wife Pojaman were not involved in fund companies, including SC Assets, which held shares in Shin Corp, is not grounds for legal action against her.

The SEC also said the law governing stock transfers does not allow it to press charges.

This is despite the court later finding Thaksin guilty of concealing his shares.

Korn said plaintiff former Assets Examination Committee member Kaewsan Atipothi's complaint was not about the role of SC Assets, but Yingluck's perjury before the court as her statement about the actual owners of Shin Corp was ruled implausible by the judges.

The minister said he wondered if Theerachai's move was aimed at gaining benefit or appeasing a certain party.

He claimed that the panel has always told him that it knows that the Shinawatra family owned the two funds that held shares in Shin Corp, but that it cannot file charges against Yingluck due to a lack of evidence proving she was aware of who their real owners were.

Kaewsun also denied his campaign was for the benefit of Pheu Thai's arch-rivals the Democrat Party, which is hoping to win the July 3 election.

"I just wonder why people who oppose Thaksin are always linked to the Democrat Party. My view is that if you could rely on the Democrat Party, all the problems [about Thaksin] would not have existed until these days," said Kaewsun.

She wasn't cleared, as such.

She provided false documents, but because she wasn't required to provide documents, they said it didn't matter.

She lied, but because she wasn't under oath, she didn't actually break the law.
