Ending Work

Featured Replies

Good Day to all,

a friend of mine resigned from work in thailand and the 15th of Aug his WP will expire

the 1 year NON B will expire in september

now he is suppose to bring the WP to labour department for close it the 15th of AUG,

it seems he should also go there with the passport and the labour department will cxl the 1 year NON B VISA letting him an extra stay of only 1 week starting from the WP cancellation (AUG 15th)

is it correct?

does WP end so also VISA end?

actually he wish to spend 15days freely around thailand without any border run or so, possible in some way?

thanks as ever

If your friend is in Thailand on a multiple entry Non-Immigrant "B" visa that has not been extended by Immigration in Thailand (i.e. he is NOT on an Extension of Stay based on employment), then his Non-Immigrant visa remains valid until September and he can continue to get permission to stay for 90 days on each entry. However, if he received an Extension of Stay based on employment then that extension expired on the day he resigned and, technically at least, he is currently overstaying.

"...he should also go there with the passport and the labour department will cxl the 1 year NON B VISA..."

That should read 'immigration office', not labor department.

As said day of employment ending is the end of an extension of stay and you are required to report to immigrant to cancel. There is no allowed time to stay after that. But you can apply for a new extension of stay with normal TM7/1,900 baht fee to allow 7 days more before you must leave.

thanks,

right now he is in extension of permit to stay (1 year until september),

so as i understand, the end of WP bring the end of the permit of stay,

but everywhere there are info telling he has 7 days to bring back the WP starting from the ending day, nobody mention the TM7 (which offer a maximun 7 days)

so, if if WP ends the 15th AUG and he brings the WP back the 21st AUG, is he in overstay??

Yes he is.

He is overstay now if he has already resigned. The last day of work is when the extension of stay must be canceled regardless of work permit return. It company gives him a letter his work ends August 15 and he reports to immigration that day to cancel he would then have a chance to extend 7 days but he must pay for it (it used to be provided and still is for BOI one stop but for others the new no days is in effect).
