If we have all other things in place for settlement visa for unmarried partner- such as rental agreement, funds, proof of relationship, daughter given British citizenship but the weak point is perhaps a fail of the a1 English test( she can do a bit of joined up writing, say the alphabet ,tell the time). I remember reading on the home office website that it doesn't matter what is included in the application as long as it is not bogus.

we have lived together in Thailand for around eight years now and have a seven year old daughter together so maybe this applies-

In some cases, the Home Office can grant settlement entry clearance. This gives your partner permission to settle in the UK permanently as soon as he or she arrives. To get settlement entry clearance, you must:

  • have been living together as if you were married for at least four years: and
  • have spent that four years outside the United Kingdom: and
  • now be returning to the UK to settle here together.

Without meeting the basic English language requirements the application will be rejected. There may be some scope for a visa outside the usual rules but I suspect there would need to be particular extenuating circumstances.

The answer to the question it is crucial!
