Hello,

I am married to a thai national (my husband) for over 2 years and we would like to get a Non immigration O visa based on marriage. My visa expires 26.12 so I would like to know what papers are needed to get this kind of visa. I have read that the following is needed:

  1. Application form T.M. 7 with one photograph size 4x6 cm. and Visa Fee 1900.-Baht. -> I assume the application form I get with the immigration office?
  2. Copy of passport ( with certified true copy ) -> I assume that I (austrian passport) need to have a certified copy? Is that really necessary or is it good enough to go with my passport and one copy?
  3. Required documentation for applying visa in case of

To be supported from Thai husband

  1. Marriage certificate -> We have that
  2. Child’s Birth certificate -> We have a child and he has a Thai passport, is the passport good enough or do we need to organize the birth certificate?
  3. Husband’s house registration -> Is that the house where he is registered with his name? Also if he is registered in Pathumthani does he have to go to Pathumtani immigration or can this be done anywhere?
  4. Husband’s identity card -> We have that available
  5. Recording interviewing the husband and wife for confirming status of husband and wife -> Any idea how long this takes?
  6. House’s map, picture of House’s and family -> Where can I get a map of the house? Are pictures of the house and the family really necessary?

Also how long are processing times. I would like to avoid any overstay as I still also could cross the border and get a Non Immigrant visa from e.g. Laos embassy.

If anyone has experiences with this kind of visa, I would be really very happy to get a feedback.

You are asking about an extension of stay from Immigration and that requires you have a non immigrant visa entry. Do you? If not and less than a week remaining on your current stay it might be best to visit Laos for a single entry non immigrant O visa. If you have non immigrant entry or more than a week remaining it can be done at immigration (for entry would cost another 2,000 baht).

You must apply at immigration office serving your residence.

At least two copies of everything will likely be required outside of Bangkok. Certified only means you sign the copy.

You should have birth certificate - not sure if passport would be accepted.

House registration is the blue book where he is listed.

You both visit immigration and it may take a few minutes or hours depending on how busy. Actual interview will likely be 15-20 minutes.

For map all they would want is what you provide a delivery service - just so they can find you. Photos may not be required with child but help to prove the relationship otherwise.

I saw someone last week at Suan Phlu with a drawn map of directions to their place, the Officer redid it for them as it was so bad. I use my condos website and there is a map there so easy for me.

Lops right, it depends on what visa you currently have. If you are on a non-O then you can apply for the extension, if not, you need to get a non-O and then apply for the extension shortly before it expires

If you are applying outside of Bangkok you will need two copies of everything (including photos)

Your husband needs copies of his house registration book (tabien ban) doesn't matter where he lives for the application, but he needs copies of his blue house book.

You will need photos of the two of your together and of you child- in front of the house address is best

Hand drawn map to your house is necessary

You will need a current updated kor ror 2 (marriage register) from the Amphur, it should be online so you should be able to get a copy from any amphur.

Check with your Immigration officer, we have to supply copies of his latest personal income tax payment but some may not require it.

Assuming you got married in Thailand you will need copies of your marrige license, if you got married overseas then I am pretty sure you need a MFA certified translation into Thai but not 100% sure on that.

In her original post although she didn't say what type of visa she has, she did say that it expires on 26 December so she should have time either way.

In addition to the marriage certificate, doesn't she need the updated marriage registration form from the Amphur where she was married (Kor Ror 2?)?

Since she is married to a Thai and she plans to extend based on that marriage does she have to worry about getting the childs birth certificate? Will it make it easier?

I had a Non Immigrant Visa O that expired 4th of November. I came to Thailand 30.10 and they gave me as normal the 3 months until 27.01. As we had to go to England last week I came back on 27.11 and they only gave me until 26.12 as they said my Non Immigrant Visa O that is multiple entry has expired. The fact that I had a stamp until 27.01 before didnt interest them and they now just gave me 30 days. I have been married in Thailand so I have a Thai wedding certificate. So I guess it means I dont have a Non Immigrant Visa O anymore and have to go to Laos to the Thai embassy to ask for another Non Immigrant O Visa? If so what papers do I need in order to get that?

It seems to be really not very straightforward to get a visa. I am married. My husband after the initial hassle has a residence in the UK and nobody is asking anything anymore. Even if I would get a Non Immigrant Visa based on a marriage do I have to regularly leave the country every 3 months? Also I assume I am not able to work with that kind of visa - correct?

You have a Visa Exempt Entry.

Pop along to immigration and covert it to a Non Imm O Visa. (2,000 Baht)

You can then apply for a twelve month extension.(1,900 Baht)

You would then not need to leave the country every 3 months but report to immigration every 90 days.

Yes you can work providing you have a Work Permit.

BTW if you think applying as a Foreign Wife is a PIA, try being a Foreign Husband. :(

I was in Suan plu on the 14th and had all the paperwork you mentioned except the childs birth certificate and the house map.

I said we handed over the birth certificate last year when I applied first and that was fine.

I did not have a house map and the employee asked me to draw a map of the condo on a piece of recycled paper she gave me. I drew it on the fly and it was fine.

I paid 1900THB and am now in my 1 month 'Trial period'.

Anyone out there knows when I need to go back next month (after 1 month trial) if:

Partner must join again this time?

How much would the expenses be?

Need to take the same series of documents with me once again?

They would give you 30 days. It should be stamped in your passport. It won't say 'trial'. It's 'under consideration'.

Not required for a foreign Wife.

I thought it was required for the thai husband to show his tax returns and also paying tax.

To proved that he can support his wife.

Depends on the office or officer apparently, we've always had to show ours which is why I included it in the list that I posted. The thing is, the man is the legal head of the family in Thailand and that is why the onus is on the man, a Thai man actually fills out a form requesting his wife be allowed to stay in Thailand and the interview is with him, not the wife.

So this is a legal requirement which is just not enforced or required?

There is no set legal requirement other than below (per police order 777/2551) unless Thai spouse is female:

(1) The alien has obtained a temporary visa (NON-IM)

(2) Proof of family relationship

(3) In the case of a spouse, the marital relationship shall be de

jure (legitimate) and de facto;
