my long term gf soon to be wife is now 11 weeks pregnant here in the uk she is due to go back next month . i will be traveling with her and staying with her family for 1 month

my question is will i be able to get her a settlement visa whilst in thailand and get her back in the uk to have our baby before june 23rd or will she have to reside in thailand for 6 months been as she has stayed with me for 5 months already.

There is no reason why she cannot apply for settlement immediately she returns to Thailand. The "maximum of 6 months out of 12" convention (not rule) applies to time spent in the UK as a visitor, not settlement.

She will need to tell the IoM when booking her TB test that she is pregnant; they may do a sputum test instead of an X-ray.

If you have the time, she could take her English test in the UK before returning next month; this will save you time once in Thailand.

To qualify as unmarried partners they need to have been living outside the UK in a relationship akin to marriage for at least the last two years.

They could, if they have the time, marry in the UK, but she would still need to return to Thailand to apply for settlement.

i took a similar path to this it takes upto 4 months for your application to be processed you can start filling in the online application form for settlement now, and see the checklist for what your need to take with you etc.

At the I,O,M. they will do a sputum test over 4 days then you get result on the 5 day so best to get hotel booked near to the i,o,m. saves wasting time travelling back and forth

You can register your mariage before your ceremony although you will probally want to include some of your wedding photo's in your application

your application is unlikely to be processed in 1 month

Worth checking approximate processing times in UK settlement time thread. Until recently there were some very prompt processing times even for settlement. Some have been processed in a few weeks. The normal expectation is 8-12 weeks from submission!

Just a bit of advice :jap: if all works out as planned put the I,O,M, certificate in her hand luggage as ukba will ask to see it when she returns

can we apply for this whole process as unmarried partners or does this only apply if we have lived together outside the uk for 2 years as partners.. i just dont see why we have to marry just to satisfy the uk border rules .. if we have to get married then we will .. id rather get married when the time is right maybe in a couple of years when the baby is born and we are more settled this would take the pressure off what is the best solution hope somebody else has had the same experience

My apologies, according to Para 295A(i)(a)(i) of the immigration rules the parties do not need to have been living together outside the UK; I was mixing this up with the requirement for ILE.

However, they do need to have been living together in a relationship akin to marriage for at least the last two years, and whilst time spent living together in the UK while she is here as a visitor will count and short periods apart, e.g. for work, are allowed, if for most of the last two years she has been living in Thailand and you in the UK then I'm afraid that you don't qualify as unmarried partners.

Because the rules say that unless she satisfies the unmarried partner rules, marriage is the only way she can settle in the UK as your partner.

If the time is not yet right for marriage, what on earth are you doing having a baby together!?

Having a baby together is a commitment; so is marriage. If one is not yet ready for the latter, can one be ready for the former?

Hi my question is my wife and I are just married she will be expecting our baby around mid June.. We have been together for 3 years she has visited me in uk twice and I to see her several times.. We are in the process of a spouse visa to stay with me for the two years and eventually indefinite will the Eco grant her a visa in time to have baby in uk we have give the 3 month allocated time for the process or is it better to be born in Thailand and then will she and our baby be able to then come and stay with me.. Does it improve couples chances of visa settlement if pregnant or not? Or is it best not mention it ?

For a settlement visa pregnancy should be irrelevant. As long as the application shows that your wife satisfies all the requirements and you can support her 'without recourse to public funds' then a visa should be issued.

Possibly the limiting factor will be restrictions on flying in late pregnancy. This may be more of a problem if the processing times are long. I am not sure if pregnancy would qualify as compassionate grounds to allow expedited processing. I suspect not.

But the birth is 6 months away; apply now and the visa should be issued in plenty of time for her to fly before the birth.

Just managed to put all rellevent documentation for spouse visa together and wife has appointment this Friday 10th feb... She is now exactly 21weeks pregnant.. Does anyone know what the waiting time is at this moment providing all paperwork is correct.as would hope for her to be in the uk by 1st April fingers crossed

UKBA figures indicate that settlement visas are being processed in 10-40 working days, 30% were processed in 10 working days, with all applications processed in 40 working days.

Those figures are for December and can change as they get busy.

Hi has anybody come across this situation in spouse visa application. They are requesting I fax audited accounts as i am self employed does this mean profit and loss an cash forecasts as I do my self to satisfy the inland revenue or does it have to be certified from official accountancy people... I have only recently done myself my tax return online and paid the tax I was due can I just simply print of these details with profit and loss that I did and fax those would this satisfy there requirements I think I'm getting close but not sure..

We have just received one back after 33 working days ( around 6 -7 weeks ). It was submitted on 26th January.
